Resolution relating to the first amendment to agreement with outside counsel in the matter of Antoine D. Young v. City of Milwaukee.

Analysis

This resolution approves and authorizes the Office of the City Attorney to enter into a first amendment to a contract with the law firm of Lindner & Marsack, S.C., to continue to provide legal services and representation to the City of Milwaukee in the case entitled Antoine D. Young v. City of Milwaukee, Wisconsin Equal Rights Division Case No. CR202501320, and any related state or federal court litigation subsequently filed.

Body

Whereas, On May 28, 2025, Antoine D. Young filed a discrimination complaint against the City of Milwaukee in the Wisconsin Department of Workforce Development entitled Antoine D. Young v. City of Milwaukee, Equal Rights Division Case No. CR202501320; and

 

Whereas, On July 31, the Office of the City Attorney was authorized in CCFN 250294 to hire outside counsel to provide legal services and representation to the City to investigate, defend, and advise the City on the Equal Rights Division complaint, and any related state or federal court litigation subsequently filed, in the matter; and

 

Whereas, On August 5, 2025, the City entered into a contract with the law firm of Lindner & Marsack, S.C. to defend the City defendants in the above-referenced lawsuit; and

 

Whereas, The initially authorized amount not to exceed set for the contract was $30,000; and

 

Whereas, The cost of legal services has exceeded the initially authorized amount, and an additional $30,000 is deemed necessary to cover costs through discovery, the next phase of litigation; now, therefore, be it

 

Resolved, That the Office of the City Attorney and appropriate City officers are authorized to negotiate and execute a First Amendment to Contract for Legal Services with Lindner & Marsack, S.C., and, be it

 

Further Resolved, That an amount not to exceed $30,000.00 is appropriated from the City Attorney’s Office Outside Counsel Expert Witness Special Purpose Account Number 0001-1490-S157-06300 to fund payments under this First Amendment to Contract for Legal Services with Lindner & Marsack, S.C.; and, be it

 

Further Resolved, That the Office of the City Attorney is directed to expend up to $30,000.00 from this account for this purpose.
