Resolution authorizing and directing the Commissioner of Public Works, upon receipt of a signed State/Municipal Agreement from the Wisconsin Department of Transportation, to proceed to undertake the programming and construction of East Lincoln Avenue (excluding structure) from East Bay Street to East Lincoln Memorial Drive under the Municipal Street Improvement Program Discretionary and to seek Wisconsin Department of Transportation reimbursement for construction costs upon the project's completion. (Infrastructure Services Division)
Analysis
This resolution authorizes and directs the Commissioner of Public Works to proceed with the programming and construction of East Lincoln Avenue (excluding structure) from East Bay Street to East Lincoln Memorial Drive under the Municipal Street Improvement Program Discretionary (MSIPD).The Municipal Street Improvement Program provides for 50% reimbursement for eligible construction costs. The City will be entitled to receive reimbursement of construction costs up to a maximum amount of $353,949.75 for the reconstruction of East Lincoln Avenue (excluding the structure) from East Bay Street to South Lincoln Memorial Drive.  Construction funds for projects undertaken under the MSIPD program will be established in future resolutions.  This resolution also authorizes the City Comptroller to establish project/grant chartfield values for preliminary engineering for this project for which the City is responsible for 100% of the costs.
Body
Whereas, State Statute 86.31 establishes a Discretionary Municipal Street Improvement Program (MSIPD) to provide up to 50% reimbursement by the State of eligible costs for reconstruction of East Lincoln Avenue (excluding structure), from East Bay Street to South Lincoln Memorial Drive; and
 
Whereas, Section 86.31 provides entitlement for county trunk highway, town road and city and village street improvements; and
 
Whereas, The Common Council has previously authorized the Commissioner of Public Works to apply for Discretionary Funds for projects which meet the program criteria as the Commissioner deems appropriate; and
 
Whereas, An application for funding under the Municipal Street Improvement Program Discretionary (MSIPD) was submitted for reconstruction of East Lincoln Avenue from East Bay Street to South Lincoln Memorial Drive; and
 
Whereas, The signed project application form acts as the City's commitment to pursue the project and upon Wisconsin Department of Transportation (WISDOT) approval for funding an executed Project Agreement is sent to the City; and
 
Whereas, Included as part of the MSIPD project application is an Agreement for partial reimbursement funding under the MSIPD Program; and
 
Whereas, East Lincoln Avenue (excluding the structure) from East Bay Street to South Lincoln Memorial Drive has been approved by WISDOT as eligible for funding under the MSIPD Program, however, the actual construction will be approved through future Common Council actions; and
 
Whereas, In 2004-2005, under the MSIPD Program, the City of Milwaukee is entitled to receive reimbursement up to a maximum amount of $353,949.75 for reconstruction of East Lincoln Avenue (excluding structure) from East Bay Street to South Lincoln Memorial Drive; and
 
Whereas, Funds for East Lincoln Avenue to be undertaken under the MSIPD Program are budgeted in the Street Improvement - State and/or Federal Aid Program Fund in the 2004 and 2006 Capital Improvement Programs (Fund 0333 and Fund 0330); now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public Works, upon receipt of the executed Project Agreement from the Wisconsin Department of Transportation (WISDOT), a copy will be attached to Common Council Resolution File No. 040261, and will be incorporated into this resolution by reference as though set forth in full shall proceed to undertake the programming and the reconstruction of East Lincoln Avenue (excluding structure) from East Bay Street to South Lincoln Memorial Drive for funding under the MSIPD Program; and, be it
 
Further Resolved, That upon completion of East Lincoln Avenue (excluding the structure) from East Bay Street to South Lincoln Memorial Drive, the Commissioner of Public Works shall submit the Request for Reimbursement to the WISDOT for this project; and, be it
 
Further Resolved, That the City Comptroller is hereby authorized to create within the Capital Improvement Fund, Grant and Aid Projects, the necessary Project/Grant Chartfield Values for preliminary engineering for the projects (Expenditure) and transfer to any of these accounts the amount required under the grant agreement and City Accounting Policy but not to exceed a 10 percent increase of the total amounts reserved for the grantor's share and local share or $5,000, whichever is greater, as follows:

Further Resolved, That only project contractual expenditures are to be billed toward the MSIPD program grant amount; and, be it
 
Further Resolved, That the City Comptroller will make a memorandum entry at the completion of the MSIPD program projects to record the transaction back to the Street Improvement - State and/or Federal Aid Program for grant audit purposes.
