Body
Whereas, Plaintiff, Berry Beverly, by his attorney, William Sulton, filed a lawsuit against the City of Milwaukee, alleging injuries and damages; and
Whereas, On September 5, 2020, Berry Beverly was operating his motor vehicle when a collision occurred with a Milwaukee Police vehicle, which failed to come to a complete stop at a flashing red light and whose lights and sirens were not on; and
Whereas, As a result of the collision, Plaintiff alleges substantial economic and non-economic damages in the form of past, present, and future pain, suffering, disability, and medical expenses and loss of enjoyment of life; and
Whereas, Counsel for the parties have reached agreement to settle the above-referenced lawsuit for a total amount of $150,000.00 subject to approval by the Common Council; and
Whereas, The City Attorney recommends and the Common Council of the City of Milwaukee deems it expeditious and just to settle this lawsuit; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that up to $150,000.00 is reserved and appropriated in the 2026 Damages & Claims Fund (0001-1490-S118-006300); and be it
Further Resolved, By the Common Council of the City of Milwaukee, that the proper City officers be and hereby are authorized and directed to issue a City check in the amount of $150,000.00, payable to the Sulton Law Firm Client Trust Account at 2745 N. Dr. Martin Luther King Jr. Drive, Suite 202, Milwaukee, WI 53212, as soon as practicable, said amount to be charged to the Damages and Claims Fund, Account No. 0001-1490-S118-006300; and be it
Further Resolved, that for and in consideration of the above-referenced payments, the plaintiff, by their representatives, and their attorneys, will provide to the City a release of any and all claims arising out of or in any way related to this incident.
