Resolution relative to the application, acceptance and funding of a Wisconsin Department of Transportation Harbor Assistance Grant Project for the Port of Milwaukee in connection with dredging and related work.

BODY:

Whereas, The water level of Lake Michigan has dropped approximately 2 feet from its level at this time in 1998 resulting is less water depth available for shipping; and

Whereas, The U. S. Army Corps of Engineers is projecting that this trend will continue for 1999; and

Whereas, The Wisconsin Department of Transportation has a grant program to assist Ports with planning and construction of dredging and related work projects with a submittal deadline of August 1, 1999 for year 2000 projects; and

Whereas, The Port of Milwaukee is projecting a need for dredging and related work; and

Whereas, A Dredging Project has been approved by the City of Milwaukee's Board of Harbor Commissioners as part of its Three-Year Harbor Development Statement of Intentions at its meeting of January 13, 1999, and has been included in the year 2000 Port Capital Improvements budget request; and

Whereas, A Dredging Project had been approved by the City of Milwaukee's Common Council as part of the Port of Milwaukee's Three-Year Statement of Intentions, and has been submitted to the Wisconsin Department of Transportation; and

Whereas, The Port of Milwaukee and the Milwaukee Metropolitan Sewerage District have identified an underutilized slip that can be closed off by a new dockwall and serve as a disposal site for approximately 100,000 cubic yards of dredge and/or other materials; and

Whereas, The Port of Milwaukee anticipates dredging approximately 3,000 cubic yards in the year 2000; and

Whereas, The project is estimated to cost approximately $1,000,000 with $800,000 coming from the WisDot and $200,000 coming from the year 2000 capital budget. Because of the timing of the grant application deadline and the approval of the year 2000 capital budget, the Port requests that $200,000 be reserved from Fund number 0481 Account PT18080110 until the year 2000 capital request is approved, now , therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the Port of Milwaukee is authorized to apply for and accept a grant in the amount of $1,000,000 [$800,000 State $200,000 City] from the State of Wisconsin Department of Transportation Harbor Assistance Program for the project identified as "Port of Milwaukee Year 2000 Dredging and Related Work"; and, be it

Further Resolved, That the City of Milwaukee formally requests assistance for this project; and, be it

Further Resolved, That the Municipal Port Director is the representative of the Board of Harbor Commissioners authorized to sign agreements, forms, claims and other required documents binding upon said Board in connection with the application for the Wisconsin Harbor Assistance Program funds; and, be it

Further Resolved, That the City of Milwaukee hereby accepts all responsibilities for the operation and maintenance of the Project upon completion of the work funded under a Harbor Assistance Program grant; and, be it

Further Resolved, That this project is consistent with the harbor development plan for the Port of Milwaukee; and, be it

Further Resolved, That this project is consistent with the three-year harbor development statement of intentions submitted by the Port of Milwaukee as required by s Trans 28.11; and, be it

Further Resolved, That the Board of Harbor Commissioners hereby agrees to provide to the Department, in a timely manner, additional analysis or documentation in support of the application, if necessary, for the review process; and, be it

Further Resolved, That the City of Milwaukee hereby agrees that it will provide such amounts of matching funds as may be required (up to a maximum amount of $200,000) upon the signing of a grant agreement and at a time and manner specified by the Wisconsin Department of Transportation in the Grant Agreement; and, be it

Further Resolved, That the City Comptroller is authorized and directed to transfer $200,000 from Fund number 0481 Account PT 18080110 (Dockwall Rehab) to an account to be set up by him for this project. If the year 2000 capital request for this project is approved, the City Comptroller is authorized and directed to reverse this transfer; now, therefore, be it

Further Resolved, That the proper City officials and/or the Municipal Port Director are hereby authorized to sign the aforementioned grant without further Common Council approval.
