TITLE
Resolution authorizing the Commissioner of Public Works to issue a permit allowing installation and maintenance of a sculpture in the public sidewalk area adjacent to the Historic Third Ward’s Public Market.
ANALYSIS
This resolution authorizes the Commissioner of Public Works to issue a permit which would allow the Historic Third Ward Association to install and maintain a sculpture in the public sidewalk area adjacent to the Public Market. The specific location for the sculpture is the northwest corner of North Broadway and East St. Paul Avenue.
BODY
Whereas, The Posner Foundation has offered to fund a sculpture to be created by the artist, Richard Taylor; and
Whereas, Upon its completion, the proposed sculpture would be donated to the Historic Third Ward Association for installation in the public sidewalk area at the northwest corner of North Broadway and East St. Paul Avenue; and
Whereas, The Association would be responsible for the sculpture’s long term maintenance and for any future liability that may arise in conjunction with the sculpture; and
Whereas, The Historic Third Ward Design Review Board has reviewed and approved the design of the proposed sculpture; and
Whereas, The Commissioner of Public Works cannot issue a permit allowing installation of the sculpture without authorization from the Common Council; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public Works is hereby authorized to issue a permit to the Historic Third Ward Association allowing the Association to install and maintain a sculpture in the public sidewalk area at the northwest corner of North Broadway and East St. Paul Avenue; and, be it
Further Resolved, That before issuing a permit, the Commissioner shall review the specific proposed location for the sculpture to ensure there are no impacts upon public safety and convenience; and, be it
Further Resolved, That the permit allowing installation of the sculpture shall be premised upon the following:
1. The Association shall maintain the sculpture at its own expense.
2. The Association shall hold the City of Milwaukee and its agents harmless and shall accept all responsibility for any and all liability that may arise through implementation of the rights granted through the permit.
3. The Association shall remove, at its own expense, the sculpture when so ordered for reasons of public necessity and shall restore the site to its former condition in conformity with standards established by the Commissioner of Public Works.
