Title
Resolution authorizing the chief of police to enter into agreements on behalf of the City of Milwaukee to provide special events security on a reimbursable basis. (City Attorney)
Analysis
This resolution establishes a city policy and authorizes the chief of police to enter into agreements to provide special events security in accordance with the terms and conditions set forth in the resolution. It provides that revenues reimbursing the Milwaukee Police Department for special events services will be available to augment budgeted expenditures.
Body
Whereas, The Milwaukee Police Department provides general and adequate police protection within the City of Milwaukee; and
Whereas, The Milwaukee Police Department periodically receives requests to provide a security detail for special events; and
Whereas, The city attorney has advised that the City may condition the provision of such special events security detail upon the special events reimbursing the City for the cost of the special events security detail; and
Whereas, The common council is desirous of establishing guidelines to the chief of police for the provision of special events security detail and for expenditure of the revenues therefrom; now, therefore be it
Resolved, By the common council of the City of Milwaukee that the chief of police is authorized to provide special events security under the following terms and conditions:
1. A written contract between the city and the special events executed on behalf of the city by the chief of police and approved by the city attorney.
2. Expenditures for special events security detail shall be charged against the budget accounts of the Milwaukee Police Department. The costs of special events security shall be reimbursed by the special events and used to augment budgetary accounts in the Milwaukee Police Department charged for the special event security detail.
3. The Milwaukee Police Department shall keep accurate records relating to each special event security detail. Each special event shall be billed within 30 days of charges being incurred. Reimbursements that are not received from the special event within 30 days of billing shall be charged with interest at the legal rate of 5% simple interest.
4. The common council finance committee shall receive an activity report from the chief of police monthly on all contracted special events security detail, the amounts charged to budgeted funds for each such contracted special event, amounts billed to each special event, reimbursements received from each special event and the allocation of reimbursements to augment the authorized Milwaukee Police Department budget.
5. The special event must agree to indemnify and hold harmless the City of Milwaukee, the chief of police, their officers, agents and employees, and any and all claims, actions and judgments arising from the alleged negligence of the special event or its officers, agents and employees or from the alleged failure of the special event, its officers, agents and employees to request sufficient numbers of police personnel to provide an adequate special event security detail. If the city or the chief of police, their officers, agents and employees receive a claim falling within the scope of this indemnification they shall tender the claim to the special event and the special event shall either accept the tender of the claim or pay all reasonable attorney fees, costs and disbursements incurred by the city in the defense of the claim.
6. The city in its sole discretion may purchase insurance to cover its liability in providing special event security detail. If the city purchases such insurance, it shall charge the premium cost to each special event on a pro rata basis.
