Analysis
This resolution authorizes settlement of litigation brought by Nancy E. Grider in the United States District Court for the Eastern District of Wisconsin, entitled Nancy E. Grider v. City of Milwaukee, Department of Public Works, Water Works Division, et al, Case no. 00-C-156.  Ms. Grider had an earlier EEOC Charge No. 260990579 based upon the same allegations.  The settlement agreement, which is attached to the file, provides a total payment of $33,000, or which $28,000 represents attorney fees and costs, and $5,000 represents back pay.  The parties further agree to enter into a separate, full and final compromise settlement of Nancy E. Grider's workers compensation claim and Ms. Grider agrees to resign her employment with the City of Milwaukee.

Whereas, Nancy E. Grider filed a lawsuit alleging hostile work environment, sexual harassment, and sex discrimination in violation of Title VII of the Civil Rights Act of 1964, as amended, and alleging violation of the United States Constitution, regarding her employment as an operator in charge at the Water Works division over the course of her employment, and further alleging that she became unable to work due to said allegations; and
 
Whereas, The parties have agreed to settle this lawsuit in the amount of $33,000.00 of which $28,000 represents attorneys fees and costs, and $5,000.00 represents back pay, from which all appropriate payroll deductions will be made including state and federal taxes; and the parties agree to enter into a full and final compromise settlement of Nancy E. Grider's workers compensation claim concerning the same allegations;  and, the plaintiff, Nancy E. Grider waives and release any and all other or further damage claims, including pension contributions, and agrees to resign her employment with the City of Milwaukee,  as set forth in the Settlement Agreement and Release attached to the file; and
 
Whereas, The City Attorney recommends and the Common Council of the City of Milwaukee deems it is expeditious and just to settle this lawsuit, and now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee that the City Attorney be and hereby is authorized to executed the  Settlement Agreement attached to this file; and, be it
 
Further Resolved, By the Common Council of the City of Milwaukee that the proper City officers be and hereby are authorized and directed to issue a City check, at such time as is required by the settlement agreement,  in the amount of $28,000.00, payable to Lawrence P. Zieger, which represents attorneys fees and costs, upon receipt of a release of claims, approved as to form and execution by the City Attorney, and that these funds shall be appropriated from Water Works account No. 0410-6411-634005-0364-R999-2001; and, be it
 
Further Resolved, By the Common Council of the City of Milwaukee that the proper City officers be and hereby are authorized and directed to issue a City check at such time as is required by the settlement agreement, in the amount of $5,000.00 to Nancy E. Grider which represents back pay, and from which all necessary and appropriate payroll deductions will be made including all federal and state taxes, in full and final settlement of this lawsuit and any related matter, upon receipt of a release of claims, approved as to form and execution by the City Attorney, and that these funds shall be appropriated from the Water Works payroll account No. 0410-6412-602401-9900-R999-2001.
