This ordinance creates a moratorium until after December 31, 1997, on direct seller licenses, both new and renewal. During the moratorium no direct sellers shall be issued for applications filed after __________, 1997.
BODY:
Whereas, The Common Council has determined that direct sales on the public way interferes with use of the public way for its intended purpose, and has therefore regulated direct sales on the public way through enactment of code provisions, including but not limited to s. 95-1, dealing with the licensing of direct sellers; and
 
Whereas, The Common Council has determined that the current number of licensed direct sellers has interfered with the use of the public way for its intended purpose with respect to the flow of pedestrian traffic and the orderly ingress and egress to and from premises abutting the public way; and
 
Whereas, The Common Council wishes to examine existing direct seller regulations and associated provisions and their effects on the use of the public way for its intended purpose; and
 
Whereas, It is therefore appropriate to declare a moratorium on the issuance of direct seller licenses until the appropriate committee of the Common Council has examined direct seller regulations and furnished findings and recommendations to the Common Council, and the Common Council has had an opportunity to review and act on those findings and recommendations; now therefore
 
The Mayor and Common Council of the City of Milwaukee do ordain as follows:
 
Part 1. Section 95-1.5 of the code is created to read:
 
95-1.5. Direct Sellers Licensing Moratorium.
 
1. PURPOSE. The city, in excerase of its authority to issue direct seller licenses, follows licensing procedures and practices that can best meet the needs of the people of Milwaukee while maintaining the use of the public way for its intended purpose. The city recognizes that the number and locations of direct sellers can significantly impact on the use of the public way for its intended purpose with respect to the flow of pedestrian traffic and the orderly ingress and egress to and from premises abutting the public way. Because the needs and circumstances of direct seller licensing in Milwaukee may change over time, the city finds that an in-depth examination of such policies and procedures is timely and necessary. For that purpose a temporary moratorium on direct seller licenses is established herein.
 
2. DIRECT SELLER LICENSING MORATORIUM. a. A moratorium on the issuance of direct sellers licenses, both new and renewal, is established commencing on the effective date of this section [city clerk to insert date] and terminating after December 31, 1997.
 
b. During the moratorium no direct seller licenses shall be issued for applications filed after __________, 1997.
