Analysis

This resolution accepts Sewer and Water Easement SE-2666A and WE-867, located in South 4^th Street between West Klondike Place and the alley 108 feet north of West Klondike Place, and in the north portion of West Klondike Place between South 4^th Street and South 5^th Street.

Body

Whereas, South 4^th Street between West Klondike Place and the alley 108 feet north of West Klondike Place was conveyed by Quit Claim deed to CBC Properties by the County of Milwaukee Executive and the County Clerk per Resolution Number 99-14(a)(b) which was adopted by the Milwaukee County Board of Supervisors at a meeting held on April 22, 1999; and

Whereas, West Klondike Place between South 4^th Street and 5^th Street was vacated per City of Milwaukee Common Council Resolution Number 001252 which was adopted on September 25, 2001; and

Whereas, There is an existing City of Milwaukee 8" diameter sanitary sewer, 12" diameter storm sewer and 12" diameter combined sewer in said portion of South 4^th Street and West Klondike Place; and

Whereas, There is an existing City of Milwaukee 6" diameter water main in said portion of South 4^th Street and West Klondike Place; and

Whereas, The easement for said sewers and water main is in the property owned by CBC Properties, and

Whereas, Sewer and Water Easement SE-2666A and WE-867, granting permission to the City to construct and maintain sewers has been granted by CBC Properties and approved as to contents, form, and execution by the proper City officers; and

Whereas, Sewer and Water Easement SE-2666A and WE-867 will also grant the City the right of entry in and across the property and with the right to inspect, enlarge, reconstruct and relocate as may become applicable said sewers and water main; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the City of Milwaukee hereby accepts Sewer and Water Easement SE-2666A and WE-867, said Easement document being attached to this Common Council Resolution File Number 011313 and incorporated in this resolution by reference as though set forth in full; and, be it

Further Resolved, That said Easement document shall be recorded and copies distributed by the Department of Public Works.
