Title
Substitute resolution to vacate a portion of North Commerce Street located between North Humboldt Avenue and North Weil Street extended, in the 6th Aldermanic District.
Analysis
This substitute resolution vacates the above portion of street in accordance with vacation proceedings under power granted to the City of Milwaukee by Section 66.297(1), Wisconsin Statutes, and Section 81-308-28, Milwaukee Code of Ordinances. This vacation was requested by the Redevelopment Authority of the City of Milwaukee to allow for future sale and redevelopment of the site.

Whereas, It is proposed that a portion of North Commerce Street located between North Humboldt Avenue and North Weil Street extended be vacated pursuant to the provisions of Section 66.297, Wisconsin Statutes; and
Whereas, The Department of Public Works has been authorized and directed to prepare a coordinated report estimating all costs and benefit assessments that will be incurred with said vacation; and
Whereas, This proposed vacation has been reviewed in accordance with Section 81-308-28, Milwaukee Code of Ordinances; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee that said portion of street, as indicated by Exhibit A and bound and described by:
That part of North Commerce Street in the Northwest 1/4 of Section 21, Township 7 North, Range 22 East, described as follows:
Commencing at the Northeast corner of said 1/4 Section; thence South 00 deg. 18 min. 59 sec. East, along the east line of said 1/4 Section, 637.00 feet to a point; thence North 89 deg. 46 min. 49 sec. West 50.00 feet to the point of intersection of the west line of North Humboldt Avenue and the present Northerly north line of North Commerce Street; thence South 00 deg. 18 min. 59 sec. East, along the west line of North Humboldt Avenue extended and parallel to the east line of said 1/4 Section, 75.00 feet to its point of intersection with the present Northerly south line of North Commerce Street; thence North 89 deg. 46 min. 49 sec. West, along said Northerly south line, 74.57 feet to a point; thence South 61 deg. 42 min. 18 sec. West, along said Northerly south line, 161.77 feet to a point in the west line of Block 5 of Chas Quentin's Subdivision, a recorded subdivision, in said 1/4 Section and the point of beginning of the land to be described; thence continuing South 61 deg. 42 min. 18 sec. West, along the Southwesterly extension of said Northerly south line, 82.73 feet to a point; thence South 58 deg. 06 min. 48 sec. West 11.40 feet to a point; thence South 14 deg. 39 min. 10 sec. West 7.11 feet to a point; thence South 25 deg. 36 min. 02 sec. East 9.54 feet to a point; thence South 28 deg. 28 min. 43 sec. Further Resolved, That upon deposit of the funds required, the Commissioner of Public Works and/or the City Engineer are authorized to implement actions listed in the coordinated report relating to said vacation; and, be it
Further Resolved, That as provided by Section 80.32(4), Wisconsin Statutes, such vacation shall not terminate the easements and rights incidental thereto acquired by or belonging to any county, town, village or city, or to any utility or person in any underground structures, improvements or services, as enumerated or otherwise existing in said description of land above described, both easements and rights and all rights of entrance, maintenance, construction and repair with reference thereto shall continue as if said portion of street had not been vacated.
