Title

Resolution authorizing the Wisconsin Department of Transportation to convert, access and utilize portions of one City-owned property for the South Lincoln Memorial Drive project from Jones Street to Carferry Drive in the 14th Aldermanic District.

Analysis

This resolution permits the City of Milwaukee to authorize use of city-owned parcel as necessary for a highway reconstruction project.

Body

Whereas, The Wisconsin Department of Transportation (WisDOT) is undertaking a highway reconstruction project to reconstruct South Lincoln Memorial Drive project from Jones Street to Carferry Drive and needs to acquire permission for itself and its contractors to access and utilize city-owned property at one (1) location; and

 

Whereas, Lands needed for the improvements are owned by the City of Milwaukee; and

 

Whereas, the portions of City-owned parcels totaling 0.87 acres of the various parcels is converted to roadway right-of-way; and

 

Whereas, the portions of City-owned parcels totaling 0.64 acres of the various parcels is necessary for construction activities; and

 

Whereas, WisDOT’s Standard Specifications for Highway and Structure Construction (2025 Edition) (“WisDOT Standard Specifications”) includes provisions regarding protecting and restoring property (Sec. 107.11) and responsibility for damage and tort claims (Sec. 107.12) that are necessary to protect the City’s interests with regard to damage to city-owned property and any tort liability resulting from WisDOT’s contractor’s use of city-owned parcels pursuant to this resolution; now therefore be it

 

Resolved, By the Common Council of the City of Milwaukee that permission is hereby granted to WisDOT and its contractors to access and utilize city-owned property as described in this resolution for purposes of the South Lincoln Memorial Drive project from Jones Street to Carferry Drive National Highway Freight Program (NHFP), and to take such further acts as are or may be necessary to effectuate this resolution; and, be it

 

Further Resolved, that the permission granted herein is conditioned upon WisDOT including the

WisDOT Standard Specifications in any agreements with contractors accessing and utilizing the City owned parcel for the South Lincoln Memorial Drive Project
