Analysis
This Substitute Resolution authorizes and directs the CPW to execute agreements with the WISDOT and Marquette University to implement streetscape and pedestrian improvement work around the Marquette campus under a Congestion Mitigation/Air Quality Program (CMAQ) grant.  The agreements include the WISDOT project agreement and an agreement
between the City and Marquette for project responsibilities and maintenance.  The project is eligible for 80% Federal/State participation.  The estimated cost is $989,830.  The local share (20%) will be funded by Marquette, including City project related work. The Substitute
Resolution also authorizes the City Comptroller to establish project subaccounts and transfer funds and also authorizes the CPW to undertake the CMAQ project work.
Body
Whereas, The City of Milwaukee, on behalf of Marquette University (Marquette), has requested a Congestion Mitigation/Air Quality (CMAQ) grant from the Wisconsin Department of Transportation (WISDOT) to undertake streetscape and pedestrian improvements on West Wisconsin Avenue from North 16th Street to North 11th Street, on North 16th Street from West Clybourn Street to West Wisconsin Avenue; and on North 12th Street from West Wisconsin Avenue to West Wells Street in the area of the Marquette campus; and
 
Whereas, The improvements, which are eligible for CMAQ funds, involve jointed sidewalks and special jointed crosswalks; precast concrete curb with railing median curbs; stamped and colored concrete pavement; portals (monuments); and new street lights, new street furniture and new street plantings; and
 
Whereas, WISDOT has indicated that funding assistance for 80% of the estimated cost is available; and
 
Whereas, In order for Marquette to qualify for the funding grant, they must have a public sponsor for the project; and
 
Whereas, Marquette has requested that the City act as public sponsor on this project; and
 
Whereas, Prior to the City agreeing to be public sponsor on the project, it is necessary that the City and Marquette enter into agreements to define each party's roles and responsibilities for implementing the project; and
 
Whereas, Many of the streetscape improvements planned are unique in nature and are being installed at the request of Marquette and thereby should be Marquette's maintenance responsibility; and
 
Whereas, Marquette has indicated that they will provide the local share (20%) of the project costs, including all City costs associated with the project; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public Works (CPW) is hereby authorized to negotiate and execute an agreement with Marquette, a draft copy of which is attached to the Common Council Resolution File Number 020163, and is incorporated in this resolution as though set forth in full, to define the City's and Marquette's roles and responsibilities for programming, preliminary engineering, construction and construction management necessary to implement the CMAQ project; and, be it
 
Further Resolved, That the CPW is hereby authorized and directed to execute a project agreement with the WISDOT for programming and construction of the CMAQ grant project, a draft copy of which is attached to Common Council Resolution File Number 020163 and is incorporated in this resolution as though set forth in full; and, be it
 
Further Resolved, That the draft Maintenance Agreement attached to this file is hereby approved and the proper City officers are hereby authorized and directed to execute it on the City's behalf; and, be it
 
Further Resolved, That the CPW is hereby authorized and directed to enter into a future agreement with WISDOT pertaining to the cost participation for the installation and/or modification of street lighting facilities in conjunction with the improvements of the aforementioned projects; and, be it
 
Further Resolved, That the CPW is hereby authorized and directed to install the street lighting and other facilities included in the CMAQ grant streetscape project necessary in conjunction with the aforementioned projects, following the execution of the CMAQ agreement; and, be it
 
Further Resolved, That the City Comptroller is hereby authorized to create within the Capital Improvement Fund, Grant and Aid Projects, the necessary CMAQ Project/Grant chartfield values for design, construction and street lighting for the projects (Expenditure) and transfer to any of these accounts the amount required under the grant agreement and City Accounting Policy, but not to exceed a 10 percent increase of the total amounts reserved for the grantor's share and local share or $5,000, whichever is greater, as follows:

Further Resolved, That minor revisions to the agreements that do not change the intent are hereby authorized and approved; and, be it
 
Further Resolved, That the CPW is hereby authorized and directed to bill Marquette for their share of the CMAQ project costs.
