Resolution restricting construction in the Solvay Coke Redevelopment Project Area in the 12th Aldermanic District. (Redevelopment Authority)
Analysis
This resolution satisfies the statutory requirements of Section 66.1333(6)(e) of the Wisconsin Statutes regarding the prohibition of new construction in a Redevelopment Project Area by the Common Council after a Redevelopment Plan has been certified by the Redevelopment Authority of the City of Milwaukee. Adoption of this resolution pursuant to this Subsection of Wisconsin Law is mandatory, not elective.
Body
Whereas, On May 5, 2001, the Common Council of the City of Milwaukee ("Common Council") adopted File No. 001786, which authorized and directed the Redevelopment Authority of the City of Milwaukee to prepare a Redevelopment Plan for the area bounded generally by East Greenfield Avenue, the Kinnickinnic River, and the Union Pacific Railroad Company right-of-way, pursuant to the applicable provisions of Section 66.1333, Wisconsin Statutes; and
Whereas, On October 12, 2001, the Common Council adopted File No. 010731 approving a Redevelopment Plan for the hereinabove described area, now known as the Solvay Coke Redevelopment Project Area, dated August 2001; and
Whereas, On November 27, 2001, in a communication related to File No. 010731 and to this File, a true and correct copy of the above identified Redevelopment Plan was certified to the Common Council pursuant to Section 66.1333(6)(e), Wisconsin Statutes, as amended, with a request that all new construction within the Project Area not consistent and/or in conformance with the Redevelopment Plan be permanently prohibited as mandated by said Section; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee regarding the Redevelopment Plan certified by the Redevelopment Authority of the City of Milwaukee pursuant to the provisions of Section 66.1333(6)(e), Wisconsin Statutes, as amended, for the Redevelopment Project Area known as Solvay Coke, a copy of which is attached to this Common Council File, that:
1. No new construction (including substantial remodeling, conversion, rebuilding, enlargement, extension, or major structural improvements on existing buildings, but not including ordinary maintenance, remodeling, or changes necessary to continue occupancy) shall be permitted or authorized by any agencies, boards, or commissions of the City of Milwaukee under local codes or ordinances.
2. The City Clerk is authorized and directed to transmit a certified copy of this resolution to the Commissioner of Neighborhood Services, the Commissioner of Health, the Commissioner of City Development, and to such other agencies, boards, and commissions of the City of Milwaukee having administrative jurisdiction in the premises described and located within the Project Area.
