Analysis

This resolution authorizes the proper City Officers to execute Partial Easement Release SER-2133, located in North 9^th Street between West Juneau Avenue and West Winnebago Street in the 4^th Aldermanic District.

Body

Whereas, On December 4, 1962 the City of Milwaukee was granted an easement for various utilities located in the then vacated North 9^th Street between West Juneau Avenue and West Winnebago Street; and

Whereas, A 60-foot wide right-of-way at North 9^th Street between West Juneau Avenue and West Winnebago Street was dedicated to the public for right-of-way purposes in 2006; and

Whereas, The utilities in the part of the easement located outside of the limits of the 60-foot wide North 9^th Street right-of-way between West Juneau Avenue and West Winnebago Street have either been abandoned or are no longer in use by the City; and

Whereas, North 9^th Street between West Juneau Avenue and West Winnebago Street is now a public right-of-way; and

Whereas, The part of the easement to be released is no longer required for utility purposes and does not serve the interest of the City of Milwaukee and should be released; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the proper City Officers are hereby authorized and directed to execute Partial Easement Release SER-2133, a copy of which is attached to the Common Council Resolution File Number  090041 and incorporated in this resolution by reference as though set forth in full; and, be it

Further Resolved, That after said partial easement release has been executed by the proper City Officers, they shall be forwarded to the office of the City Attorney for approval as to form and execution and then to the Department of Public Works for recording and proper distribution.
