Resolution directing the Commissioner of Public Works to execute a Project Agreement titled “State/Municipal Agreement for a Transportation Alternatives Program (TAP) Project” with the Wisconsin Department of Transportation and to set up design at a total estimated cost of $403,744 with an estimated City of Milwaukee share of $80,749 and a grantor share of $322,995.
Analysis
This resolution authorizes and directs the Commissioner of Public Works to execute a Project Agreement with the Wisconsin Department of Transportation for the planning, design, and construction of a Transportation Alternatives Program project with 80 percent Federal and State Aid under the Transportation Alternatives Program. This resolution also directs the City of Milwaukee Comptroller to transfer funds and establish project grant chartfield values for the preliminary engineering for this project. The total estimated cost of the project is $2,259,606 with a grantor share of $1,807,685 and a City share of $451,921. The total estimated design cost for the project is $403,744, with a grantor share of $322,995 and a City share of $80,749. Construction funds for this project will be included in a future resolution.

Whereas, the project agreement has been requested from the Wisconsin Department of Transportation to be executed by the City of Milwaukee for design and construction of the following project under the Transportation Alternatives Program (TAP):

Whereas, The Department of Public Works shall notify the Common Council of the City of Milwaukee of project cost overruns and changes in scope approved by the Department of Public Works; and
Whereas, The Common Council of the City of Milwaukee recognizes that the City may be 100 percent liable for project cost overruns and changes in scope as approved by the Department of Public Works; and
Whereas, The Common Council of the City of Milwaukee recognizes that the City may be liable for any costs incurred by the State should the City decide to withdraw from the project; and
Whereas, Construction funds for the project will be included in a separate resolution; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee that the Commissioner of Public Works is hereby directed to execute the Project Agreement for the design review and procurement of the aforementioned projects with Federal and State aid under the Transportation Alternatives Program, a copy of which is attached to and incorporated in this resolution by reference as though set forth in full; and, be it
Further Resolved, That the Commissioner of Public Works is hereby directed to undertake, or engage a consultant to undertake, design for the above-mentioned project and to reimburse the Wisconsin Department of Transportation for procurement costs they incur for the improvements; and, be it
Further Resolved, That minor changes to the agreement which do not change its intent are hereby approved; and, be it
Further Resolved, That the City Comptroller is hereby authorized to create within the Capital Improvement Fund, Grant and Aid Projects, the necessary Project Grant Chartfield Values for design for the project (Expenditure) and transfer to any of these accounts the amount required under the grant agreement and the City Accounting Policy but not to exceed a 10 percent increase of the total amounts reserved for the grantor’s share and local share or $5,000, whichever is greater, as follows:
