Title

Analysis
This charter ordinance amends the global pension settlement to provide that the increased survivorship benefits to $300/$600 per month, effective with the installment next following January 1, 2000, will apply to all beneficiaries who began receiving survivorship benefits before January 1, 2000, or who are eligible to receive a survivorship benefit in the future due to a death occurring prior to January 1, 2000, and who participate in the combined fund.
Part 21 of Common Council File No. 991585 implemented the agreement by amending s. 36-05-8-b-12 of the charter to provide the increased benefit to widows or widowers and children under 18, but failed to take into account beneficiaries of the survivorship fund include children over 18 who were disabled prior to age 18 and dependent parents. This charter ordinance amends that charter provision to conform to the agreement of the parties.

The Mayor and Common Council of the City of Milwaukee do ordain as follows:
Part 1. Section 36-05-8-b-12 of the charter is amended to read:
36-05. Benefits.
8. SURVIVORSHIP BENEFITS.
b. Dependents.
b-12. For beneficiaries of policemen whose date of death occurs on or after October 5, 1973, and for beneficiaries of firemen whose date of death occurs on or after July 28, 1974, survivorship benefits payable in the amount of $115 per month shall be increased to $140 per month and payable in the amount of $230 per month shall be increased to $280 per month under the terms and conditions set forth in subd. 11. For beneficiaries of firemen whose date of death occurs on or after March 1, 1979, survivorship benefits payable in the amount of $140 per month shall be increased to $175 per month and payable in the amount of $280 per month shall be increased to $350 per month under the terms and conditions set forth in subd. 11. For beneficiaries of firemen whose date of death occurs on or after March 1, 1981, survivorship benefits payable in the amount of $175 per month shall be increased to $200 per month, and payable in the amount of $350 per month shall be increased to $400 per month under the terms and conditions set forth in subd. 11. For beneficiaries of policemen whose date of death occurs on or after September 19, 1981, survivorship benefits payable in the amount of $140 per month shall be increased to $200 per month and payable in the amount of $280 per month shall be increased to $400 per month under the terms and conditions set forth in subd. 11. For beneficiaries of firemen whose date of death occurs on or after March 1, 1984, and policemen whose date of death occurs on or after January 1, 1985, survivorship benefits payable in the amount of $200 per month shall be increased to $300 per month, and payable in the amount of $400 per month shall be increased to $600 per month under the terms and conditions set forth in subd. 10. Effective with the installment next following January 1, 2000 for [[those widows, widowers and children]]>>beneficiaries<< who began receiving survivorship benefits before January 1, 2000 or who are eligible to receive survivorship benefits in the future due to a death occurring prior to January 1, 2000, and who participate in the combined fund, survivorship benefits shall be increased to $300 per month for widows or widowers age 57 without children>>,dependent parents<< and [[a]] >>an eligible<<single child [[under age 18]] (no widow or widower) and $600 per month (for widows or widowers with >>eligible<< children [[under age 18]] and 2 >>eligible<< children [[under age 18]], no widow or widower).
Part 2. This is a charter ordinance and shall take effect 60 days after its passage and publication, unless within such 60 days a referendum petition is filed as provided in s. 66.0101(5), Wis. Stats., in which event this ordinance shall not take effect until submitted to a referendum and approved by a majority of the electors voting thereon.
