- Analysis - This substitute resolution designates the Milwaukee Access Telecommunications Authority ("MATA") as the City's access manager for purposes of sec. 99-11, Milwaukee Code of Ordinances, and the City's renewal franchise agreement with Time Warner Cable of Southeastern Wisconsin LP ("Time Warner"). The resolution also authorizes the execution of a contract between the City and MATA under which MATA commits to undertake public and educational access responsibilities under the City's cable contract with Time Warner. The city also delivers $9 million over the remaining term of the renewal franchise agreement to MATA for capital and operating purposes, including the acquisition of the necessary capital equipment and to either purchase or lease a facility to be used for the delivery of those access services. In addition, the resolution extends until July 1, 2000, the time for a public access funding committee to report back to the Utilities and Licenses Committee.
 
BODY:
Whereas, The Milwaukee Access Telecommunications Authority, Inc., ("MATA") is a not for profit corporation organized in Wisconsin which provides community media production, training and outreach services on a City wide basis; and
 
Whereas, The city has entered into a cable services Franchise Agreement with Time Warner Cable of Southeastern Wisconsin, LP ("Time Warner") to provide certain channels, facilities and resources dedicated for local public, educational and government use; and
 
Whereas, In accordance with Chapter 99, Milwaukee Code of Ordinances ("MCO") and the franchise agreement between the City and Time Warner, the City may designate access managers to control and manage the use of any or all of the channels, facilities and resources provided by Time Warner for local use; and
 
Whereas, Under File 980528 the Common Council directed the City Clerk to negotiate with MATA for a long term access management contract; and
 
Whereas, Under the Agreement for Services attached to this file, the City designates MATA as an access manager, for the purposes of Chapter 99, MCO, and the Time Warner renewal franchise agreement, and assigns control and management of certain facilities and resources under such franchise; now, therefore be it
 
Resolved, By the Common Council of the City of Milwaukee that pursuant to sec. 99-11-5, MCO, and the City's renewal franchise with Time Warner, the City hereby designates the Milwaukee Access Telecommunications Authority, Inc., as the City's Access Manager for the provision of public and educational access services; and, be it
 
Further Resolved, That the proper City officers are hereby authorized and directed to execute the Agreement for Services attached to this file between the City and the Milwaukee Access Telecommunications Authority, Inc., and be it
 
Further Resolved, That the public access funding committee created under File 981230 is hereby granted an extension of time, until July 1, 2000, to report back to the Utilities and Licenses Committee.
