Title

Resolution granting permission to the Village of Brown Deer to provide water service to 8453 N. 68^th Street in Milwaukee.

Analysis

This resolution authorizes the Commissioner of Public Works and the Superintendent of the Milwaukee Water Works to enter into an agreement for the provision of water service to 8453 N. 68^th Street in Milwaukee by the Village of Brown Deer Water Public Utility in accordance with the provisions of Resolution 920828.

Body

Whereas, North 68^th Street from West Dean Road to West Brown Deer Road is a boundary street between the City of Milwaukee and the Village of Brown Deer; and

Whereas, The City of Milwaukee does not currently have water services available for the properties on the west side of said street; and

Whereas, Resolution 920828 authorized the Commissioner of Public Works and the Superintendent of the Milwaukee Water Works to enter into an agreement for water service with said Village and each of the owners of said properties and that the agreement shall provide that: 1.  The Village of Brown Deer does not hold itself out to provide water service to any other customers beyond its contract boundaries, 2. Should the Milwaukee Water Works ever serve any or all of the customers directly, it may require them to disconnect from the Brown Deer water system and reconnect to the Milwaukee Water System, and that said water service agreements shall not become effective until executed and approved by the Public Service Commission and the Public Works Committee of the Common Council of the City of Milwaukee; and

Whereas, The owner of 8453 N. 68^th Street has requested water service to this property through the distribution system of the Brown Deer Water Public Utility; and

Whereas, The Village of Brown Deer and the Public Service Commission have approved the provision of water service to this property through Resolution No. 93-02 and letter dated January 5, 2006, respectively; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public Works and the Superintendent of the Milwaukee Water Works are authorized to enter into an agreement for water service that complies with the provisions of Resolution 920828.
