Analysis
This substitute resolution authorizes and directs the Commissioner of Public Works to execute a project agreement with the Wisconsin Department of Transportation and the Federal Government for the programming and construction of shoreline protection improvements and a pedestrian/bike trail along City of Milwaukee property adjacent to the Milwaukee Art Museum.  This resolution also authorizes the Commissioner of Public Works to let construction contracts for the project.
Body
Whereas, It is the City of Milwaukee's goal to provide and enhance public access to the City's waterfronts; and
 
Whereas, It is the City of Milwaukee's goal to provide a continuous bike/pedestrian trail network linking various attractions and destinations within the city of Milwaukee; and
 
Whereas, The Hank Aaron State Trail will provide a route along the Menomonee River linking attractions located in The Menomonee Valley, including Miller Park, with lakefront attractions including The Henry Maier Festival Park and the planned Lakeshore State Park; and
 
Whereas, The Milwaukee County Oak Leaf Trail network provides an existing route along the lakefront from the Henry Maier Festival Park and the planned Lakeshore State Park through Veterans Park and Lake Park, including a segment on City-owned lands adjacent to the Milwaukee Art Museum addition; and
 
Whereas, The segment of the Oak Leaf Trail north of the City-owned segment was recently reconstructed by Milwaukee County to comply with current AASHTO bike trail design standards and to stabilize the Lake Michigan shoreline; and
 
Whereas, The existing trail segment on City-owned lands does not comply with AASHTO bike trail design standards and is not expected to support bike/pedestrian demand resulting from completion of the Milwaukee Art Museum addition; and
 
Whereas, With the imminent completion of the Milwaukee Art Museum addition, it is desirable that the trail segment on City-owned lands be reconstructed to accommodate increased bike and pedestrian demand resulting from the Milwaukee Art Museum addition and comply with current AASHTO bike trail design standards as well as stabilize the Lake Michigan shoreline and provide wave protection for the Milwaukee Art Museum addition; and
 
Whereas, The City of Milwaukee has made application for funding under the Transportation Enhancement (TE) Program to reconstruct the City-owned bike trail segment known as the Lakefront Bike Pedestrian Trail Project; and
 
Whereas, The WISDOT has approved this application and submitted a Project Agreement to be executed by the City of Milwaukee for the programming and construction of the project with federal aid under the TE Program; and
 
Whereas, The project cost is estimated at $660,000, of which the grant will fund $528,000 with the remaining cost of $132,000 to be funded equally by the City of Milwaukee and the Milwaukee Art Museum; and
 
Whereas, Should actual project costs exceed $660,000, the City of Milwaukee and Milwaukee Art Museum shall fund 50% each the excess cost up to a maximum total project cost of $708,000 corresponding to a maximum additional contribution of $24,000 each; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee, that the CPW is hereby authorized and directed to execute the Project Agreement for the programming and construction of the Lakefront Bike/Pedestrian Trail Project, a copy of which is attached to Common Council Resolution File Number 001076, and is incorporated as though set forth in full; and, be it
 
Further Resolved, That the CPW is hereby authorized and directed to undertake or engage a consultant to undertake design for the above-mentioned project and to reimburse the WISDOT for design costs it incurs for the project; and, be it
 
Further Resolved, That the CPW is authorized to let construction contracts for the project; and, be it
 
Further Resolved, That the City Comptroller is hereby authorized to create within the Capital Improvement Fund, Grant and Aid Projects, the necessary Project/Grant Chartfield values for design and construction for the project (Expenditure), and transfer to these accounts the amount required under the grant agreement and City Accounting Policy, but not to exceed a 10% increase of the total amounts reserved for the grantor's share and local share of $5,000, whichever is greater, as follows:

Further Resolved, That the City Engineer is hereby authorized and directed to approve and make periodic payments to the WISDOT upon receipt of invoices for the local share of costs of the project.
