Title

Substitute resolution approving levying of assessments and construction of assessable public improvement projects at various locations.

Analysis

This resolution confirms the report of the Commissioner of Public Works, as modified by the Common Council Committee, on projects for which Public Hearings have been held.  The resolution authorizes the levying of special assessments and directs the installation and construction of said public improvements.

Whereas, The Common Council of the City of Milwaukee adopted preliminary resolutions, determining it necessary and in the public interest to construct and levy special assessments for the following improvements:

 

2nd Aldermanic District

 

Alley between W. Chambers St., W. Moltke Ave., N. 66th St., and N. 68th St. (ST212020116) File Number 000838:  Concrete alley pavement reconstruction, replace some abutting sidewalk or driveway approach, and grading. (Assessable Alley Paving Fund -- $64,800; Nonassessable Alley Paving Fund -- $18,300)

E. Deer Pl. – S. Burrell St. to (West) S. Greeley St. (ST211020141) File Number 86-1468:  Concrete pavement reconstruction, replace all of the curb and gutter, replace sidewalk and driveway approaches where needed, sodding, and grading. (Assessable Reconstruction Paving Fund -- $27,000; Nonassessable Reconstruction Paving Fund – $55,200)

Whereas, The report of the Commissioner of Public Works has been filed with the City Clerk; and

 

Whereas, Notices have been sent to all interested persons and public hearings held; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public Works' Report, as amended at said Public Hearing, is approved and the properties therein identified are benefited; and, be it

 

Further Resolved, That said Commissioner of Public Works is authorized and directed to proceed with said work in accordance with said report pursuant to Section 66.0703 and any other pertinent sections of the Wisconsin Statutes and in the manner directed by Section 115-42 of the Milwaukee Code of Ordinances; and, be it

 

Further Resolved, That the proper departments take such action as is required of them to assess the abutting or adjacent properties and collect such assessment in the manner directed by Section 115-42 of the Milwaukee Code of Ordinances, and, be it

 

Further Resolved, That the City Comptroller is authorized and directed to transfer such funds which are available for this purpose to the appropriate capital Project/Grant accounts; and, be it

 

Further Resolved, That the projects do not involve any parcels of agricultural land which are eligible for deferred special assessments under the provisions of Section 14.30 of the Milwaukee City Charter; and, be it

 

Further Resolved, That upon request of the property owner (tax key number 354-0403-100-5) the special assessment for storm sewer in E. Dock St. be deferred until application for connection to said storm sewer is made.  Cost for deferred charges shall be in accordance with City Charter 12-10; and, be it

 

Further Resolved, That projects: Alley W. Chambers St. (ST212020116), W. Chambers St. (ST211020110), W. Vienna Ave. (ST211020135), Alley N. Evans St. (ST212020106),  N. 24th St. (ST211020136), Alley W. Chambers St. (ST21210125), W. Scranton Pl. (ST21110112), S. 83rd St. (ST211020137),  will be billed after January 1, 2004, and that the projects: S. 21st St. (ST211020115), S. 26th St.  (ST211020140), E. Deer Pl. (ST211020141) and Alley W. Mineral St. (ST211020114) will be billed after January 1, 2005 ; but not before 12 months after the project contract has been completed; and. be it

 

Futher Resolved, That the following projects be deleted from the 2002 Paving Program.
