Analysis

This resolution authorizes payment to the United States District Court for the Eastern District of Wisconsin relative to the lawsuit Joseph Walker v. City of Milwaukee, Case No. 20-CV-0487-NJ, for the total amount of $2,321,297.15.

Body

Whereas, Plaintiff Joseph Walker filed a civil rights lawsuit against the City of Milwaukee and certain employees of the City of Milwaukee, Case No. 20-CV-0487-NJ, in the United States District Court for the Eastern District of Wisconsin; and

 

Whereas, the case was tried to jury from November 27, 2023 to December 1, 2023, and thereafter the jury returned a verdict in favor of the Defendant City of Milwaukee but returned a verdict in favor of the Plaintiff on his claims against the named City employees; and

 

Whereas, on March 29, 2024, the Court docketed judgment awarding $2,000,000.00 in compensatory damages to the Plaintiff, Joseph Walker, as well as $239,373.00 in attorney’s fees, and $9,547.12 in taxable costs as against the named City employees; and

 

Whereas, on July 30, 2024, the Court docketed amended judgment awarding $1,000,000 in compensatory damages after granting, in part, Defendants’ motion to alter or amend judgment; and

 

Whereas, on October 11, 2024, the Court docketed amended judgment awarding $2,000,000 in compensatory damages after granting, in part, Plaintiff’s motion to alter or amend judgment; and

 

Whereas, the City of Milwaukee has a statutory obligation to indemnify City employees for judgments arising in the course and scope of their employment pursuant to Wis. Stat. § 895.46, and Plaintiff’s claims against the named City employees arose in the course and scope of their duties as City employees; and

 

Whereas, the City Attorney recommends and the Common Council of the City of Milwaukee deems it expeditious and just to pay this claim; now, therefore, be it

 

Resolved, by the Common Council of the City of Milwaukee that proper City officers be and hereby are authorized and directed to issue the following City checks in the following amounts: to the Clerk of Court for the United States District Court for the Eastern District of Wisconsin as security pending appeal for compensatory damages, costs and fees, and interest in the amount of $2,321,297.15.

 

Further Resolved, that in compliance with the City Attorney’s direction, the proper City officers be and hereby are authorized and directed to issue a check, as soon as practicable, in full and final settlement of all claims arising from the motor vehicle accident, to be charged as follows: to the Damages and Claims Fund, Account No. 0001-1490-S118-006300.
