The applicant was present and represented by Atty. Ovbiagele.
The police report was read.
Atty. Ovbiagele said that for item 28, it was a situation where security guards were doing their job with a patron being removed and the security guard was assaulted. He explained that the DA cleared the charge as self defense. As for item 29, he said that it was about a patron who was kicked out and hit a guard with a vehicle and that he thinks that the business was the victim in this case. For the February 23,2026 event, he said that his client confirmed that the person was never at his establishment and that there is no evidence that the shooting is linked to the business nor his client. He added that he has talked to his client regarding the license checks and that there were bookkeeping issues for not having the proper receipts. As for the
premix beverages found, he said that his client had a large event that day and they premixed margaritas and long island tea, but that his client has changed his operations for large events since then. For the March 13, 2026 incident, he said that it was a large crowd where police had to assist.
Individuals also present:
Ald. Burgelis asked who made the determination that the shooting victim was not at the location when the surveillance video was not available.
Atty. Ovbiagele said that on the narrative of the report it mentions that MPD talked to different people and that is how they narrowed it down. He added that his client was not aware that a shooting happened and that he was not at the bar when the police asked for the surveillance footage. He also said that MPD came back for the footage at a later time.
Ald. Burgelis asked the applicant if he had given access to the surveillance system to other staff members when needed.
The applicant answered “yes”.
There were no neighbors present to testify.
Ald. Taylor said that the applicant is in communication with her, that he makes attempts to rectify situations that occur, but that he must be more diligent when it comes to young people entering the establishment. She added that she is aware that AI makes it difficult to detect fake ids but there have been two occasions where MPD had to disperse large groups of underage people fighting. She recommended a 15 day suspension.
Atty. Ovbiagele said that they have been in communication with Ald. Taylor throughout the year and that her position surprises him. He added that the second item is the most problematic with the intoxicated driver; they check ids but technology advances quickly and it cannot keep up with fake ids. He also said that he understands the nature and seriousness of the incidents but that his client has not been given any disciplinary action before.
Ald. Brower moved renewal with a 10 (ten) day suspension based upon the preponderance of the evidence on the police report that demonstrates the operation results in a threat to the health, safety or welfare of the public. There were no objections. (Prevailed 5-0)

Individuals also present:
Ald. Zamarripa said that the applicant was at her reserved spot at Burnham Park every day of the suspension dates except for the day that MPD told her to shut it down.
The applicant said that in regard to the suspension, she thought that she needed to close immediately after the hearing and that she called her employees to do so. She added that she used that time to make repairs on the truck and that she has support documentation that she got the truck back on October 8th, 2025. She also said that she went to the License Division after she got her truck back thinking that she would get the license issued but she was told that the suspension was about to start.
Ald. Burgelis said that according to the applicant’s statement, she admitted that she operated on the suspension dates and has used an unlicensed vehicle.

Ald. Zamarripa mentioned for the record that two letters were sent to the applicants on October 2nd and October 14th, 2025, with the disciplinary action and the specific dates for the suspension. She added that she hears nothing but excuses, it is unacceptable and is not fair to the many food truck owners who are responsible and trying to get a reserved spot in a food truck zone while the applicant has not been responsible. She added that she needs to advocate for her neighbors and food truck owners and that she recommends a suspension.
Ald. Zamarripa asked to abstain from voting because she has offered a lengthy testimony today.
Ald.
