Minutes note: 12 ASSAD, Wisam A, Agent for "RIO CREPES & GELATO LLC", Extended Hours Establishments and Food Dealer Licenses Application Requesting to Close 2AM Everyday for "RIO CREPES & GELATO" at 130 S WATER St #100. The applicant was present. The police report was read. Att. Gresham said that there is no need to address the police report as the applicant did it few minutes ago. No new comments from the applicant. Individuals in opposition: Bryan Montgomery- 130 S Water St #203 – said that he lives there and that he is president of the HOA and that the extended hours are not permitted per the condominium rules and regulations which is to end noise at 10PM and, that the previous owner had hours until 8PM. He explained that these units are purchased because of the spacious decks that sit right onto this commercial space that are directly impacted. He also said that the license application says that there was not going to be any construction but there is and with all kinds of noise. Ald. Perez asked Mr. Montgomery the relation between the commercial space and the HOA. Mr. Montgomery explained that they held a brief zoom meeting with the new owner (not the applicant) with no communication after until the last couple of weeks, when they were told that the interest was transferred. The applicant said that he is no longer pursuing the extended hours. Ald. Perez asked the applicant if he reached to his office after filing the application. The applicant said that Ald. Perez contacted him. Ald. Perez said that he reached out to him after he was scheduled for the first time and explained to him that there was a homeowners association concerned especially about the hours of operation, and that he responded that he was going to reach out to talk to them. The applicant said that he is not the unit owner and that the unit owner supposed to be in attendance and that he was going to resolve the matter. Ald. Perez said that he advised the applicant to talk to the HOA regarding the hours for his own operation and that we are here today with him not attending the meeting neither amending his application. He added that the applicant made it someone else’s responsibility. The applicant said that he is confused because he was under the impression that the unit owner needed to do it. Ald. Zamarripa asked the applicant if he wants to remove the extended hours. The applicant said that the new hours will be from 8AM to 10PM everyday. Ald. Jackson moved removal of the extended hours application and to change the hours to 8AM-10PM everyday. There were no objections. James Rozewicz - 130 S Water St #311 – said that the amended hours are fine but there have been a lot of irregularities with this transaction and that he thinks that the condominium rules won’t be followed because they haven’t since they purchased it. He added that the sudden transfer of the premises and applicant’s background are also concerning. Answering the applicant’s question, he responded that an example of rules not followed is that the application says that no construction will be performed on site, but there is. Bruce Westley - 200 S Water St – he said that neighbors have been here two times, that the applicant did not show at the first hearing and that he would have appreciated if the applicant be here in person. He added that the change of the hours help; but that he is concerned about the applicant unlawfully running the business as he has showed with the application heard prior this one. He added that the applicant has not given any confidence to the neighbors. Carrie Bedore - 130 S Water St #217 – said that she shares the concerns of her neighbors and regarding this unit she said that tile work has been done, that they asked for a specific construction work plan that has not been shared, so they do not know if the proper permits have been pulled. She also said that in the meantime, the tile leveling materials dripped into the garage's unit below and that it has not been cleaned yet. She also explained that few weeks ago they asked permission to drill to install a grease trap which it is out of the scope. She added that there are so many red flags about this operation. Chris Remington – 130 S Water St #212 – said that it is a highly residential section and none of the restaurants are open beyond 10PM. He added that he is concerned about the construction and the more he learns today, the more concerned he is. Lane Kuske – Resident at Riverpoint Condominium – said that his balcony is directly across this potential business, that a previous hearing was scheduled and ignored, that the applicant knew that there is a lot of opposition, that there is a lot of shady business with this application and that all the businesses around close at 10PM. Anne Kuske - 106 W Seeboth #705 –said that she echoes all of the neighbors' concerns and that she is uneasy because she does not know what the business is going to be, that the meeting with neighbors did not happened and asked the committee to proceed with caution. Anna Mascarehnas - 130 S Water #201 – said that she is confused with this application because of the extended hours first, then an ice cream shop and now it is a coffee shop. She added that there have been certain irregularities with the occupancy and contract, that she lives below the store and she is concerned about the construction work and possible leaks. She also said that she was abroad for two months and has not checked her garage yet. Scott Fitzgerald – 130 S Water St #409 –said that he agrees 100% with everything what his neighbors have said and that he is not sure if this a viable business. Judy Kaplan - 130 S Water St #205 – said that she questions how much further out the applicant can go when he said that he will sell crepes and gelato. She added that even before the first hearing, the applicant started to cover the windows with black plastic and that they do not know what is happening in that unit. David Wenstrup – 130 S Water #316 – said that he is concerned about the noise and the applicant’s background but also about the possible use of the patio with a fire pit as reported by Urban Milwaukee. He asked for the specific intended use of the patio. No response from the applicant. Ald. Burgelis asked the HOA representative to testify again. Ms. Lopez confirmed that a plumber permit for this unit was pulled recently. Mr. Montgomery explained that the plumbing inside the wall is the condominium’s association property, that the applicant is attempting to transform the condominium’s property but that on the license application before us, states that no plan of construction/remodeling will be held in the unit. He added that all of the sudden, the windows are covered, construction is going on, a lot of noise with what it seemed tile work, that he saw a toilette outside and they do not know what is going on. He added that there was a request for a grease trap to be put in through the City (said by the previous owner) but that they did not heard anything until last week. He said that they need to see and approve the construction plans and that the HOA has not given any authorization to upgrade/change/alter this unit. Ald. Perez said that he has a lot concerns based on the applicant and the neighborhood testimony as well. He asked the committee to deny this license because the applicant did not follow the proper basic steps to begin with, and the lack of communication, transparency and the applicant’s background as well. Ald. Burgelis moved denial. There were no objections. (Prevailed 5-0)

Minutes note: 12 MAMALAKIS, Emmanuel, Agent for "REVIVAL ON SECOND LLC", Class B Tavern, Public Entertainment Premises and Food Dealer Licenses Application Requesting Disc Jockey and Bands for "REVIVAL ON SECOND" at 814 S 2ND St. The applicant was present. The police report. The applicant declined to make comments on the police report. Individuals in opposition: Matthew Bruan – W 222 N 5700 Miller Way, Sussex, WI – Representing Beer Capitol – said that there is a standing bill for $4,000 from Revival 414 from a year ago that they are trying to collect. Atty. Gresham said that the application in front of us is for a different legal entity and that this is not the proper body to address Mr. Braun’s concerns unless he has a court order. Dave Hollister – 810 S 3rd St – said that he is against this license due the amount of noise and clientele who parked in front of his house and walked through the alley down to the bar. He added that the difference between the bar open and closed is quite noticeable and that when the bar is open, they have a number of people parked around pre-partying in their cars, drinking, getting high, throwing bottles and food litter on the ground and that he has watched that all of them going to Revival. Ald. Perez asked if the activity stopped with Revival closed. Mr. Hollister said that it is correct. Individuals also present: Ald. Perez asked the applicant if he has other licenses under his name. The applicant said that he has a bartender license and that he is the agent for a church in Wauwatosa. He added that none of the members of the previous operation are part of his operation, that he is the only one owner, that he recognizes the mistakes that the previous business made to get in trouble and that he will be a good neighbor as well. Ald. Perez asked the applicant for his previous experience in the bar industry. The applicant said that he has none but also knows that the previous operation made financial mistakes, that he is an attorney with business experience and always wanted to jump into this business. He added that he is doing it now that his children are growing older. He also said that the previous operation own the building and that it is the only business relationship with them. Ald. Jackson moved to hold the item to the call of the chair for further discussion. There were no objections. (Prevailed 5-0)

Minutes note: 04 ODOM, Sterling O, Agent for "PICTURE DIS LLC", Class B Tavern and Public Entertainment Premises Licenses Renewal Application for "THE LOWER LEVEL LOUNGE" at 207 E BUFFALO St #LL. (Expires 9/20/2026) The applicant was present. The police report was read. The applicant said that there are 30+ galleries in the building with private events daily and that he does not know what item 1 is about. As for the second item, he said that the building held their annual 4th of July Art Gallery Gala event with all of the tenants and that they were all in the building doing their own thing, that the event was wrapped up and that he was cleaning up when the police officers came. He added that he has been in business 4 years with no issues. He also said that he is not open like a regular bar, only for private events. Individuals also present: Ald. Pratt noted that the second item on the police report was dispatched at 4:56 am, which is after the licensed hours. The applicant said that he was closed at 2 am and the people were tenants and not his customers. Ald. Pratt said that MPD arrived at 5am and he was there with other people. Ald. Bauman said that the applicant’s explanation is substantially in conflict with the police reports including the longer format and that it sounds incredibly unbelievable. He explained that the applicant has a license for a specific premise and the police reports indicate the premise was locked to them and that they saw people exiting that premise specifically and not from the rest of the building. He added that there are police reports connected specifically to this premise with people drinking after hours on at least 2 occasions. He also said that there is a credibility issue here and that he is in opposition to this license. Ms. Lopez said that the applicant has held the licenses since 2022 with no discipline. Ald. Burgelis asked if he received any citations from MPD. The applicant said that he did not but received a verbal warning for the 4th of July incident. There were no neighbors present to testify. Ald. Bauman asked Atty. Gresham what the law is for private parties in taverns. Atty. Gresham said that there is some confusion that was clarified with the passing of the wedding barn legislation. Mr. Cooney said that Act 73 states that any event that is rented out, held out for rent or made available for rent for a private party is considered a public place. Just like a tavern, it requires a Class B tavern license or a Wedding Bar license. He added that with the Class B license, holders must abide to the licensed hours and the approved plan of operations. Ald. Bauman said that these police reports say that the applicant was found operating in violation of all licensing rules and regulations twice. Ald. Bauman asked what the law is about giving police access. Atty. Gresham said that licensed establishments must grant access to police. Ald. Bauman said that along with the privilege of having a license comes the responsibility of allowing access to police. He added that he is concerned about this business locking out MPD and the agent not knowing about the first incident until he saw this report. He also recommended non-renewal due to the multiple layers of offenses. Ald. Burgelis moved approval with a 15 (fifteen) day suspension based upon the preponderance of the evidence in the police report, aldermanic, and applicant testimony that demonstrates the operation results in a threat to he health, safety or welfare of the public and for the failure to comply with the approved plan of operations. There were no objections. (Prevailed 5 0)

Maistelman said that the police report speaks for itself, that they did not do anything wrong and the video proofs it. Individuals in opposition: Mark Rhyner – 545 E Wells St #300 – said that he lives in a condominium with 27 units facing cathedral square park and Wells street and that they have noticed an increase of street concerns. He added that they not oppose to this license because they are good neighbors but the issues are on the street, sidewalks and bike paths with people at closing time. He explained that there is a lot of noise, speed issues, traffic and motorcycles in the area, litter that is not put away and large groups strolling around late at night. He added that the scooter issues amplify late at night. Ald. Bauman asked Mr. Rhyner to be more specific and to tag a business specifically. Mr. Rhyner said that he will do it next time. Ald. Burgelis asked Mr. Rhyner if he has seen security or bouncers walking people out to their cars. Mr. Rhyer said that he has not. Individuals also present: Ald. Bauman said that he has no objections. Atty. Maistelman said that Mr. Rhyner will have his client’s telephone number to address any issues. Israel White - 545 E Wells St #800 – said that he is new to the area but that he has seen a deep deterioration of the neighborhood and that safety, excessive noise and drinking flow all together. He said that it is very disturbing when they walk from the Rep at 11pm for example, that the area is crowded, that Taylor’s have the windows open, that the inside noise along with the one outside along with the traffic, all fuses into their building. He said that from his unit, he can see people leaving the bar not walking properly, not in a straight line and then they get into their vehicles, that they do not leave right away making more noise and that is why they are awake. Ald. Jackson moved approval. There were no objections. (Prevailed 5-0) Atty. Maistelman said that he will talk to his client about having a neighborhood meeting.

He added that they have put together a 3-page document to mitigate MPD and the neighborhood’s concerns brought up at yesterday’s meeting where Ald. Coggs was present as well. Atty. Maistelman proceeded to read the highlights of the document that will be added to the file: -Contacting the MPD Community Liaison for a walkthrough -Improving the lighting -Installing brand new surveillance system with 16 cameras connected to MPD -Posting No Loitering signs -Staff will be checking around the premises on an hour basis unless they hear/see something -Filing restraining orders against identified individuals who do not follow directions -Hourly sweeps/trash pick up -Contacting MPD proactively -Keeping an incident log -Training staff on unruly customers -Attending MPD crime and safety monthly meetings -Joining the neighborhood association Individuals in support: Raymond Rancher – 518 W Vine St - said that he is between the hotel and the store with a lot of traffic there but that the area is a food desert, that it is important to have the store, that the people standing outside the store are not there forever and that he does not understand why it is concerning to others. Elena Jones – 725 Land Pl - said that everyone in the community needs the store since it is the only one there with many people without a car and elderly that cannot afford an Uber. Individuals also present: Ald. Coggs said that this is one of two stores that she gets the most complaints from, but that this is a new application and that she wants to be fair. She added that the complaints are about garbage, the level of loitering and residents avoid driving by for fear. She also said that it is not only the store, that the crowd moves from the hotel to the store and vice versa but that neighbors have demanded a higher level of customer service and management. Ald. Coggs questioned the applicant and his responses were that he is committed to attend regular neighborhood meetings, that he will add security if needed, that he is not willing to hold the alcohol application, that police will have direct access to the surveillance system, that he will improve the interior and exteriors and will share his contact information with neighbors. Ald. Coggs added that she has no objections and that she is fine with the mitigation plan. Atty. Maistelman said that the applicant will be providing more fresh, hot food and cold subs. Ald. Jackson moved approval. There were no objections.

(Expires 9/9/2026) The applicant was present. The police report was read. The applicant had no comments on the police report. Individuals also present: Ald. Coggs asked what does it means "advised the call". Sgt. Cornejo said that it is a sort of warning if there is no violation but also confirmed that there is a citation in progress. Individuals in opposition: Richard P Steenwyk – 2203 N Weil St - said that he is happy to hear that there is a citation in progress for the violation of the 50 foot ordinance and that he is the complainant. He added that he is opposed to the entire operation because for 2 years, he and his neighbors have been trying to work with the business with no compliance. He added that the extension of premises to the patio has increased the problems and that none of bullet points of the mitigation plan presented at the revocation’s hearing by Atty. Maistelman, has been followed. Jenny Englert – 1012 E Garfield Av – President Humboldt Bridge Condo Association - said that she is representing the association and that at the revocation was said that the applicant should have been given a chance since he did not receive a warning, but that there is no compliance as Mr. Steenwyk said. She added that she has called the police 14 times so far this year, that she does not see support from MPD and that people stay in their cars prior and after being at this business. Individuals in support: Tony Jones – 2221 N Humboldt – said that she was there the 2 times that police was there and that the citation was issued because the neighbors kept calling and not because the music was heard. She added that there is no way that they can stop the noise and volume after 6-7 minutes when it was too loud to give the neighbor PTSD. She also said that this is the same people who called the applicant racial slurs so she feels that this is more because he is African American. Individuals also present: Ald. Coggs asked the applicant if he has followed up the mitigation plan, if there are points that he have not, and why. The applicant said that he has done everything except for the sound check but that police should be able to say if it is loud enough. Ms. Lopez said that the premises description is first floor and patio. Ald. Coggs asked if there have been any permits issued because she has received emails with advertisement from social media that includes DJ. The applicant said that those ads were from some promoters that he was going to use but he did not. Ald. Coggs asked the applicant if he held those events. The applicant said that he did not. Ms. Lopez said that there were no DJ permits issued. The applicant said that he has karaoke with a microphone but no DJ. Ald. Coggs asked what is the plan for the food license. The applicant said that he wants to keep people there with some food like pizzas and nachos and that the trash come from the food trucks there. Ald. Coggs asked how often he has somebody cleaning up the exterior. The applicant said that everyday. Ald. Coggs said that she is not in support of the DJ and that even if he does not make sense to him, he needs to get the sound engineer to proof that his equipment is designed the proper way. She added that this is the first time that she is made aware of the racial slurs. She also suggested to hold the citation open. Ms. Lopez said that garbage is picked up once/day. Ald. Coggs asked for 2 cleanups/day. The applicant agreed. Ald. Jackson moved to amend the plan of operation to 2 cleanups/day. There were no objections. Ald. Burgelis moved approval the Class B Tavern, Public Entertainment Premises and Food Dealer licenses adding hookah and holding the Disc Jockey and change of hours request. There were no objections.
