I am
writing in hopes that you will see that although I have had problems, I have
worked hard to resolve them when making your decision on my rooming house
license. Whatever you do, I have to abide but I feel I need fairness on my
part too. I harbor no hard feelings.
First
of all, I am enclosing a copy of the email that was sent to the DNS as far are
updates and completion of violations.
Dear Mr
Roberts: I recently had an opportunity to review your letter sent to the
Committee for the September meeting. I would like to say the
following:
The
only reason my rooming house has a number of violations is bcause of complaints
by the same people for bugs. There are other properties in the
neighborhood with the same amount if not more of violations and the rest get
away with violations because no one will complain about
them.
If you
look at my violation lists, I have completed repairs immediately and the last
time Kathy Adsit was there by herself, she indicated that she was surprised at
all the violations, I had taken care. When you give violations, I
feel that is not always fair, for example, I fixed the vent in the basement over
a year ago. It was approved by Douglas Giles and Kathy Adsit. When
you came in Mr Roberts, it was fixed, however, as Kathy explained, it was the
wrong angle. It was straight out instead of on an curved angle.
That is not a violation. The carbon mononxide detectors were up according
to the 2010 standards approved by Douglas Giles late 2010 and other inspectors
in early 2011. Now 2011 the rules have changed in Feb 2011 and
instead of letting me know, I get violations. The Fire extnguishers
were new and approved by your inspectors, you came and said they had to be
industrial. That is not a violation. It is a correction.
Kathy
said she was in training on how to do inspections properly and had about 70 more
properties to go through, you were training her. I have always complied
with the DNS and have gone overboard to show them the work I complete. Up
until Sept 2011, my violations were always approved by the DNS inspectors as
completed and satisfactory..
I was
very disturbed that in your letter, you indicated that "if" I fix the
violations. I have always fixed them and if you would go to the
other rooming houses, there are blankets on the windows and inside are not as
nice as mine. I would like you to see the pictures of the improvements, I
have done prior to the Sept 26, meeting. I am not a slum landlord or
absentee all the time. It is the same few neighbors who brought in their
friends that are the ones that filed all the complaints. Look at how nice
it looks. SO please it was not right to say I would not do what you
asked.
As far
as the garage next door, I was shocked that I got the blame for its decay.
It has been like that since I bought the building and I did not have a gutter
problem there until this year. I feel that was an unfair statement and
totally inaccurate. It blamed me for its condition and that is far from the
truth. The gutters were approved by other inspectors who went through my
building since I bought it in 2006-2010.
You
came to my house once and I let you all in any time you asked. Every
inspector gave me ok's on everything I did so I felt it was not fair for you to
judge me on one visit. You never came back and saw the improvements I did
but Kathy was pleasantly surprised that I even have most of the 30 day
violations taken care of and looked at them and saw
more.
I can
see your comments if you have gone through every rooming house, however, mine
has been targeted and so I must endure negativeism. I am a good
hardworking person who depended on this roming house for my livelihood and now
will try to make ends meet living there.
There
were 45 people at the 2008 meeting, only 18 were there for the rooming house
(families not individuals) and they were also there about other issues.
After the meeting, the neighbors said it was getting better. It is the
people next door, who cried at the meeting, that have caused all this
pain. I complained about the illegal business in their basement many times
because of all the noise and lights and late night activities. Your office
did nothing but their constant false complaints about bugs, led to this
situation for which I am distressed and sorry. I was told, Oh they moved
it to an office building. It apparently was true and they did not get
fines or anything else for not having a occupancy license or a building for
their business. Chemicals for silk screening are just as harsh as can be
and are also determintental to a child. So was the hot oven to dry the
shirts. Nothing was done and now it is ok because they moved it.
Please
see all my improvemnts prior to 09/26/11. I am not angry. I am
saddened that the same people can file false reports and I suffer the
blame. It is odd that since August, there has not been one call to you
about complaints. Isn't that odd.... They set out to accomplish my
rooming house license being revoked but I feel that if I had so many violations,
I did not do, then why did your DNS inspectors tell me I complied.
I thank
you for listening and am sad that the only time the DNS gets involved is through
complaints. You never found any bugs and said so, then that is all you
should have been looking for and the people next door should have been fined for
filing false reports. It is not a fair system and I guess I have to deal
with it but the whole thing was really unfiar and biased by false
complaints. Did you tell the people next door to fix their broken windows,
to fix the big hole in their roof that I pointed out. It is useless to fix
my roof when they have squirrels in and out and they jump on my roof. It
definitely was vendetta by these neighbors and I feel sorry for them. The
neighbors are worried that I will report all of them from what I was told, so
they are painting their porches and fixing things. Well, I mind my own
business. I am soory you could not have come back and seen the repairs and
upgrades before your letter went out.

I would
also like to address isues that were brought up in a committee meeting.
First of all I know it is an election year and everyone wants to be reelected so
this would please the neighbors and their friends to do this to
me.
Let's
address the complaint letter from Mr Mcguire:
Under
oath Mr Witkowiak said on TV, Sept 26th, that he was at the 2008 meeting, this
was false. Based on Mr Mcguire's letter, he held the meeting, Mr
Witkowiak did not attend. There were actually 45 people there and 18 of
them sighed a complaint about the rooming
house.
Mr
Witkowiak also stated in 2010, I received a notice that due to that fact they
did not follow procedure, they could not revoke my license. Again, this is
not true. Check the files and I received that notice in 2008. I
received nothing in 2009 for the 2010 renewal and in 2010 I went to a meeting
and only 15 people were there, the same ones, and the rest were there for the
bar and the school problems.
He said
it was hard to revoke a rooming house license. I had a few police calls
and only a few violations for that year. My license was renewed without
further discussion. lIsten to the tape. PLEASE. Also Mr Witkowiak
said he was contacted by the police department and drugs were found in the
rooming house. Where is this report, when did it happen? I never received
any notices or fines from the police department and when Sharon came with police
officers from the District attorney's office, they said they found
nothing.
Now to
address the police concerns. I am not saying there have not been
problems but I checked with my phone company, they have no idea why all the 911
calls say they came from my rooming house and after 10 years, this would
happen. I am having att send bills to verify. Also the calls were either
false reporting of a closed halfway house to people arguing on the porch.
It was also reported as a closed building which was not true. There were
calls from the rooming house but alot of the calls were not from the phone and I
was actually of victim of threats from people I evicted. If you look at
2010 and 2011 there were not alot of legitimate calls from my rooming
house. The last incident in the neighborhood, the police talked to our
witnesses. The officer said if someone calls against me because I evicted
him and threatens, I am the victim not the problem.
Not one
person, had any evidence of drug use everyday or alcohol use
everyday. It was the neighbors and their friends. Mr Testka cried
for the safety of his daughter, yet, he subjected her to hash chemicals from a
silk screening business in the basement. He also did not indicate of the
gangs of kids that hang on that playground. Pictures of some of them were
submitted to the committee, older children hiting at younger children and stop
sighns with sticks.
Many of
the people mentioned Jan. Well Jan was in and outof the hospital in 2010
and 2011 Check with Mount Sinai Hospital. She almost
died. So she could not have caused problems then. The neighbors made
up statements but had no eivdentiary support showing pictures, videos and any
evidence that these were true fact and not just exaggerated stories blaming all
problems in the neighborhood on my rooming house. In the 2010 meeting, I
asked for pictures and police statments to them. None were
presented.
These
13 group of people, stood outside the meeting room for over 2 hours talking
about what they were going to say. If they were to testify, they should
have been interviewed separately because everyone of their statements were
tainted by collaberating with the other people and their friends. What
upset me is that none of these people work all day and they see these problems
all day long. How do they support themselves. When they made a
complaint about something during the day, they should have been asked where they
worked, when they worked and how could they witness anything if they were at
work.
The
Teska's if you look athe the police reports from August, you will see that
I evicted tenants and they called the police on me or threatened me. I was
the victim not them or the neighborhood.
Now

loitering.
There
were calls to the police and police checking from 60/2011 to Sept 3, 2011.
Most of them were with tenants I was asked ot evict. And some of the calls were
from them threatening me,
No
calls since Sept 3 at all.
I have
had police visit for drugs, alcohol in a vending machine and I have received no
warrants. tickets, citations or anything else. It is the same people
calling the police dept for the same things but no
proof.
The
Teska Typical day 10 am starting beers, Where are the police
calls, Where are the pictures ALL hearsay Yes the police
even told me they were watching the property because of the constant complaints
of drugs and alcohol and each spot inspection or unannounced visit, nothing
found. They lost so much money in the vending machine, because there was
no liquor, just a disgrunted evicted tenant out to cause trouble.
Attracting homeless people and partying on the porch all day Where
are the police calls, where are the pictures
Mr
Testka letter: Rooseveldt on porch arguing about guns, he was evicted in
July, he was not there in august. A dispute to the police was about him
getting his security deposit back Aug 1 but he was gone in
July.,
Tenants
outside smoking pot daily, In one of his other letters, he indicated when
the wind blows east, he can smell the pot. Well that is from behind him
then because the rooming house is to the north. Also where are the
pictures or police reports Again hearsay
House
was raided by police twice...When, they came because someone said beer in the
vending machine and found nothing There is no record in the police
calls of any raids in 2010 nd 2011. When were they and why didn't I or any
of the tenants see them.
Larry
Harris was not living at the rooming house at the time of the 2010
complaint. He had been evicted, He was calling the police
about the vending machine beer and he is still in the neighborhood on 3rd st
causing trouble. I wrote to MR Witkowiak's ofice and told him, he
was not my tenant at the time. And if he threatened the mother of Teska's
where was she to collaborate the threat. No where and it was Whitney that
called the police, she did not even talk to them and she is still out with the
child next to my house daily.
2010
Loud music In the 2010 meeting Teska said it happened all the time but
only called the police once, Never taped or recorded anything.
However, they had a business in their basement and loud music and bright lights
all nite and nothing was done. I reported that to the DNS on a visit and
nothing was done.
All the
complaints about Larry Harris. He was not my tenant at the time of these
events. As far as a sex offender, there are 2 in the back rooming
house.
The
October 2010 assault was proven by the Milwa police dept that the mugging and
robbery occurred in the rooming house behind me. The Teska continue to lie
about that under oath and nothing is done.
The Red
van was the brother of a former tenant. He picked up his brother
daily. They did not sit outside and where are all the pictures or proof of
this drug dealings Just hearsay.... All the time. His brother
offered to testify...
There
is so much speculation and inuendos but where is the substaniated proof. I
am being thrown to the Wolves so the alderman's can get elected this next
term.
How
come no police calls since Sept 3 and look at all the pictures of the
improvements prior to the hearing. Where am I a slum landlord who does
nothing. How come no problems now DId the DNS come in and check my
house again NO
I have
been persecuted non stop from the people next door and thei rfriends.
Contact the woman who lived there until they bought the place, I offered to, she
had no problem with me and even offered to sell her property to
me.
I know
that with all the preasure from the neighbors and the alderman's wanting to get
elected, that I will be thrown under a bus. I can't help what they do but
when a group of people get together and discuss stories at length, with no
documented proof or pictures, then how can they be independent, unbiased because
they are friends, and creditble.
I ask
not for sympathy but for a look at the true facts and how procedure was not
followed by investigating allegations appropriately and false testamony.

it is only fair that I can address these as I could not do in the committee
meeting.
