Spenner-Hupy, the owner of the residential property located at 3340 North Windermere Court, Parcel #2780501100. Ms. Hupy's property is immediately adjacent to the northern boundary of the 3319 North Lake Drive owned by Chris and Jennifer Abele (the “Applicant”). The Applicant has applied for a Certificate of Appropriateness to construct: (i) a four-car garage and spa room, (ii) the glass enclosed swimming pool and conservatory, and (iii) associated support facilities (kitchen, laundry, bathroom) (collectively, the “Project”). HPC approved Phase I of the Project at its May 9, 2022 hearing. The Phase I approval was conditioned upon the Applicant’s submittal of a landscape plan and a lighting plan for the Project (see statements of HPC Chair Patricia Keating Kahn in video of May 9, 2022 hearing at 1:53:16). Additionally, HPC held over Phase II of the Project so the Applicant could “work with [HPC Staff] to come up with a more compatible design for the pool house roof.” (see statements of HPC Chair Patricia Keating Kahn in video of May 9, 2022 hearing at 1:53:50). The Applicant’s original proposal was to construct a glass enclosed swimming pool structure with a maximum height of 18 feet 9 ˝ inches. The published Staff Report for File #220301 includes references to a landscape plan, a lighting plan and revised design for the glass enclosed swimming pool; however, the submittal materials for File #220301 do not include a landscape plan, a decipherable lighting plan or a revised design for the glass enclosed swimming pool. We respectfully request that copies of all documents that form the basis of the Staff Report be included in File #220301 as soon as possible to allow for public review prior to the July 11, 2022 hearing. The following photographs are attached to this email to demonstrate the location of Ms. Hupy’s property vis a vis 3319 North Lake Drive and provide context for the Project’s potential impact to Ms. Hupy’s property: 1. In addition, we note that the proposed glass enclosed swimming pool fails to conform to the Guidelines for New Construction in the North Lake Drive Estates Historic District’s Study Plan, as follows: “Overall building height and bulk; the expression of major building divisions including foundation, body and roof; and individual building components such as porches, overhangs and fenestration must be compatible with the surrounding structures” (emphasis added). See Section IX, Paragraph C, Subsection 2 of the District’s Study Plan. "The building materials that are visible from the public right-of-way should be consistent with the colors, textures, proportions, and combinations of cladding materials traditionally used in the district. The physical composition of the materials may be different from that of the historic materials, but the same appearance should be maintained” (emphasis added). See Section IX, Paragraph C, Subsection 4 of the District’s Study Plan. To our knowledge, there are not any structures in the District that are compatible with the proposed glass pool house. If not properly screened, the height of the modern designed glass pool house will fundamentally change the character of the District and its glass composition will create light pollution issues for the surrounding properties. We request clarification on (i) whether the proposed glass swimming pool enclosure will be visible from the street and/or the Hupy Property, (ii) what steps have been taken to prevent light from the glass pool enclosure being visible at night from the street and/or the Hupy Property, and (iii) what landscaping will the Applicant be required to install to screen the Project from the Hupy Property.
