From: Nathan Garry Sent: Tuesday, October 31, 2023 9:40 AM To: Elmer, Linda Subject: Re: Vacant registration Fees GM Ms. Elmer Timeline for N 54th street. purchased the home 7/13/22 (3050 N 54th street) (Upon closing I received all orders and violations from the city) immediately started all renovations Completed all repairs and renovations within a 6 month window. Received a vacant registration letter from the city stating that I need to register the home as a vacant by a certain date if orders weren't corrected. (but all the violations were corrected. No representative came out to inspect the property. if they had they would have been able to see that orders were corrected. (it was as if they were just sending auto generated letters) (Received approximately 3 letters and then they kept assessing fees/penalties) I finally called DNS and asked why I keep receiving these letters when the orders were all taken care of, and asked when did they come out to inspect the property. ( they never provided an answer) I then explained that I didn't agree with the fees. I was told to supply the Energy bill/Water Bill or proof that the home wasn't vacant. I give them the information. Then they contact me and say. The home has a placard order and needs to have an occupancy permit. I then ask, when was the placard order issued? (the date given was prior to me taking ownership of the property. (I took ownership of the property on 7.13.22) and again at closing I received all orders and violations from the city at that time and started corrections and renovations immediately. So now, as I'm explaining to them that I received everything at closing (regarding violations/etc. from the city) (DNS) They tell me it's my responsibility to do a secondary title search on a property I already closed on. (Smh) So what it boils down to, the last inspection, (if there was any) was made either June/July 22' right before I closed and after the title search was completed (They sent that order (Placard) to the previous owner) (basically I was never made aware of it, I only received violation orders from the city that I corrected from that point moving forward. I said at this point, We're just going back and forth and what is the quickest way to get this resolved. because now you're telling me that I'm responsible for violations of the previous owner, They said go get an occupancy permit, when I didn't need one, but I finally went down to DNS and paid for a permit application. While down there I'm explaining to the people why I need a permit and they felt I didn't need one especially if I corrected all the repairs/violations within the 6 month window. (But they said "If you're still going to pay for one, we'll take your money anyway") I agreed but said I wanted to put everything behind me. I contacted the inspectors and only 1 came out and said I needed to add some screens to the window, before he signed off on the permit. (I'm getting the windows replaced in the spring) So I just don't understand why they are clearly so adamant on saying my home is vacant when clearly it isn't and especially when I have supplied them with more than ample evidence to prove to them that it isn't. but yet they keep charging me fees for it. (This is not fair at all) I do not agree with the vacant registration fees/ and do not agree with needing an occupancy permit. (it's as if they are just attempting to siphon money out of me at this point,) I have made a strong commitment to the city to invest my time and resources in the community. I took the worst house on a promising block and turned it into a jewel, which all the neighbors are proud of and only to get spit on in the process because the ball was dropped. I'm not going to make it personal by starting to point fingers. I love this city with every fiber in my body but it's situations like this that make people reconsider pledging their commitments to reinvesting in the city. You can tell how passionate I am about this based on the length of this email, lol lol... That's why I am imploring for another opportunity to have my appeal heard in front of the committee because I strongly protest these fees/penalties. This is their response. I had previously explained to Mr. Garry that this is a placarded property, which means it should not be occupied. His property failed the occupancy permit inspection conducted 9/5. I submitted the requested proof over to DNS that the home was never vacant after purchase because It went under immediate renovation. I was told to send the following. Water Bill/Energy Bill. I also sent photos. I was told that it wasn't proof enough. So I was at a loss. I'm arguing the point that a meeting letter for appeal was never sent out. I have been having issues with my Postal Services, because they have been delivering my mail to the wrong PO Box for sometime because there's another person at that location with the same last name (Garry) causing a mixup. Clearly you can see I'm passionate about this issue and if I did receive the notice I would have definitely made the meeting. Hope I'll be granted grace and receive another opportunity to make my appeal, because I do feel that I was unjustly hit with vacant registration fees for my property.
