211967 01.OrdinanceA substitute ordinance relating to zoning regulations for open pavilions.

Minutes note: Member Richardson commented. The current zoning code established a maximum overall height of 10 feet for an accessory-structure open pavilion in a residential zoning district. There was a need to increase the overall height up to 24 feet for other permitted non-residential uses, such as Milwaukee Public Schools wanting to install outdoor open pavilion classrooms. Numerous cases would be brought to the Board of Zoning Appeals should the overall height remain at 10 feet. There was a concern from DNS Permit Center of 24 feet being too tall. There may be consideration in the future to perhaps amend the zoning code to make the overall height increase be 14 feet instead of 24 feet or make the change only applicable to religious assembly institutions and primary and secondary schools. Members did not have a concern and said that further changes could be made in the future, as needed. Member Richardson moved that the proposed ordinance, as written, meets the standards of legality and enforceability, administrative efficiency, and consistency with the format of the zoning code. There was no objection.
