211406 01.CommunicationCommunication from the Milwaukee Police Department relating to its policies and procedures for patrol and policing entertainment districts and venues in downtown Milwaukee in general and for the "Code Red" initiative in particular.

Minutes note:  Ald. Bauman said that there was an extensive hearing for ELEMNT on the last cycle and that there was a significant discussion about what MPD do and do not do relative to policing of large entertainment venues such as ELEMNT and that this is the specific cause for bringing this file forward to discuss the policy of MPD regarding patrolling and enforcement of these major night clubs because allegations were made that the police in fact was an instigator of trouble instead of mitigate the trouble. Also said that in the more general subject (started last summer) large crowds were gathering on Water St not only in connection with the Bucks' win but on Fridays and Saturdays as well and were not patronizing businesses or bars. Explained that constituents contacted his office because of the noise, loitering, speeding cars, racing cars, underage drinking, disorder and criminal behavior with no arrests so he thinks that the Police Department must answer all the questions because they have the discretion to arrest and press charges and that also will be useful for him, for the committee and the council to understand the policy when responding to these type of disorders and what the council representing the community want them to do. Nick DeSiato from MPD made a presentation with a map of the Code Red Development Area and said that all "Policies and Procedures" related to Code Red are documented on operation plans and made clear that Code Red is not designed to provide security for the businesses but to provide a safe environment for the patrons. Explained that Code Red is between 7 pm and 3 am on Friday and Saturdays only within the map area and times and highlighted that there has been a 77% increase on calls for service. Mr. De Siato said that received a clear message from Chief Norman that MPD wants to be responsive to the elected officials. The presentation has been added to the file. Ald. Coggs asked if any of the bars on the map area has hired any off duty police officers for security. MPD said that no bar in the red code area or anywhere in the city have hired off duty police officers. Ald. Perez said that there is record of the use of the Code Red at one establishment on his district. Ald. Bauman said that the presentation was helpful but wants to know what is the operating plan, the use of the force policy. What the police is supposed to do?, What are the instructions to the officers? Ald. Coggs said that there is a lot that can be done to control larger crowds and that P33 are summarized in such way that it is difficult to measure or how drastic the situation it was but as for ELEMNT; the report said that one member of the staff was throwing a chair to a patron and no citations were given to that employee. Ald. Bauman said that the file must be held open to invite also others to weigh in and to keep the conversation going. Ald. Kovac said that the typical issue is crowds and fights outside from bars so that is the problem that must be addressed at this committee and to include more bar owners in this conversation. Beth Weirick - from Responsible Hospitality Institute - Said that it is a city wide issue and believes that the city should utilize resources proactively instead of reactively. Added that visitors and tourists are here to spend money and support businesses and jobs and there must be a conversation. Omar Shaikh - said that the business owners must to come together eventually to address the current behavior. Added that there are no movies theaters on the north side for example and he is ready to support initiatives like that. Felicia Moore - Community Activist said that she has a viable solution for this matter and that she has already started to work on it. Bobby Wilgen - said that Code Red is very important and that he has supported the work that MPD has done. Ald. Kovac moved to hold the file to the call of chair. (Prevailed 5-0)

Zamarripa said that the police report says that two employees refused to cooperate and that she is also concerned that the agent is not aware about the surveillance's video request. Added that this business must be a partner with the community because of the critical location. Rupinder Mann (husband) said that they have a couple of incidents every month and that they cooperate with MPD and that those two employees were let go back in September 28th. Added that he does not know if the employees were involved in the incident because they even closed the store that day and said that the neighbors also complained about the employees as well. Mr. Mann said that they have a very good quality surveillance system. Ald. Zamarripa said that she wanted to confirm that they have terminated the employment of the two individuals cited on the police report. Mr. Mann confirmed the termination. Ald. Zamarripa recommended renewal with a warning letter and she wants to make sure that Mr. Mann understands his commitment to the neighborhood. Ald. (Expired 11/28/2021) The applicant was present and said that she was not working at "La Caleta" but her brother and partner went to the MPD offices to fill out some papers and she was told that everything was fixed. Individuals also present: Ald. Coggs asked Ms. Hernandez if she had an explanation for the items on the police report specifically. Ms. Hernandez said that her partner is working to keep the place safe, tried to add more cameras and more security, woking in everything and always cooperating with showing the footage of the cameras. Ald. Borkowski noted that five incidents on 2021 occurred within three months and that he is concerned and curious about the alderperson's opinion. Ald. Zamarripa said that she is concerned about this business and that she called District 2 to do a further research on the premises and said that a total six shot spotter police reports have come out from this address and nothing has been done even after the police requested a new public safety plan. Added that they are all disturbing incidents including one patron being robbed after he left the bar and when the patron tried to get some help at the bar, the bar closed the door on him. The applicant said that she has owned the building for six years and used to rent it and that she had a lot of problems with the previous tenant (named Jose Luis) and that her partner who lives above the bar now, has bought the building now. Added that the previous tenant had minors living upstairs and that herself called the police because the neighbors reported that they were stealing stuff from cars. Said that after her partner bought the building they started to work on fixing everything. Ald. Perez wanted to verify for how long has owned the building and how long it took to get rid of the tenants. The applicant said that six months ago and that within a month they got rid of tenants. The applicant also said that she hopes that she gets a chance to fix this because some people rely on these jobs and that she will keep it as a family business. Ald. Zamarripa said that she appreciated the context that the applicant provided. and asked the applicant if they are still serving food. Added that she was unaware that the applicant bought the building and asked why she did not take the chance to resubmit a new public safety plan when MPD offered it. The applicant said that they still serving food and that she was busy with her baby's birth and she was told by her brother and partner that they took care of it. Ald. Zamarripa thanked the applicant for investing in the district and asked her for a meeting to discuss these shot spotter calls from this location and that she is willing to reconsider in renewing the licenses with a 2 week suspension in order and her desire to put together a public safety plan. Ald. Perez moved renewal with a 14 day suspension based on police report, aldermanic and applicant testimony. (Prevailed 5-0) Ald. Coggs said to the applicant the she hopes that she uses the 14 days suspension to come up with a public safety plan.

The applicant said that his purpose is to enhance and beautify the area and that they have reached the condo association and have had a conversation with the board. Angelique L Sharpe - 6161 N 60th St - Villard Ave Business Improvement - said that she is here to share her experiences from the past three years and that on 2022, Oasis was selected to help to bring the community back (sort of a drive) and that they were not only a financial contributor but a community partner allowing them to hold the concerts indoors because of the rain and by participating with a cultural mural, activities and community meetings. Added that Mr. Obiora is working with the police to make a safer community and to revive the neighborhood and that has up scaled the security team. Ald. Perez asked Ms. Sharpe if all the business are open as late as Oasis and if the other business are open during the day and if they have the same plan of operations because it would be a different world of perspective he said. Ms. Sharpe said that Oasis is not the only business that opens at night and pointed out the investment that they are making in their own business and the community. Ald. Perez said that he got a better feel of the environment rather than the business operations. Added that he visits the area frequently. Ald. Hamilton asked if anyone from the police department was present. He said that everything that Angelique and Homer Blow said about Oasis is true and gotten better with the years and have become an anchor or staple for the Villard Ave. but that he also wanted to be honest and said that they cannot scare away long time patrons with that kind of items on the police report. Also said that one of the things that he wants to see moving faster is that the applicant has total control of who promotes his business and there it be a commitment to his long time patrons to avoid situations that carries issues that lasts.
