She stated a parking plan is in place with overflow parking lots available. She added that the added security has helped the area. He stated that he was gone at a funeral during the inspection and the butcher that was there was not throwing away meat like he was supposed to. He added that he has since fired that butcher. He stated that he has been doing this for 30 years and he is on site every other day, and the new meat manager was hired in February, but has since been fired for not storing meat properly. He stated that he has been in Illinois to help take care of his mother, but he's in Milwaukee every other month. He stated that he was at the premises daily from January through April 2017. He stated that the new butcher will be taking the next certified food manager course. He stated that he will fix the holes identified by the pest control and will talk to the landlord about the issues. Appearing with the applicant: Atty. Emil Obviagele stated 3 inspections reports were generated on March 20th, and no fees were assessed or citations issued. He added that after the reinspection in April the premises earned 88 points which is a letter grade of an "A". He asked Ms. Evers if the premises posed an eminent health risk. He stated that a lot of these things took place with the previous owner and changes have been made since Malik took over in June. He added that the business has been in operation since the early 1990's and there have been no safety concerns, no sale of cigarettes to minors, the Near Westside Partners are not objecting, and he has a letter from a neighbor in support. He added that food checks are conducted daily with a checklist. He stated that even the best establishments can have a bad day. He stated that Malik is planning on becoming the agent next year and taking the certified food manger course. He stated that when you eradicate pests from an area the go to the surrounding properties. He provided a contract with the pest control company. He stated a lot of the concerns come from the Health Department but the Department has determined that the premises is not an eminent health risk and have improved from a "B" to an "A". He stated the premises has been in operation for almost 3 decades and the problems can be fixed. He added that he will make sure a plan is put in to place and followed. Ald. (Prevailed 5-0) Malik Mohammed 5836 S 41st St stated customers come in all the time and light their cigarettes in the winter and it is addressed on a daily basis. He stated that the person listed in the police report is his deceased father. he has taken steps to correct the issues. He stated that his father and the applicant were in charge of the store during the violations. He added that he wasn't sure why his father allowed these things to occur, but he is making changes such as doing more checks throughout the store with the bread and produce, and ordering less meat so it doesn't spoil. He stated the owner is in charge of the meat counter. He stated when he started in February he was unaware of the October complaints and he fully took over in June. He stated that he uses his senses to look for mold and to smell spoiled meat. He stated that there has been a pest control company contracted for years. He added that the pest control company was at the premises 2 days ago. Individuals also present: Ald. Bauman stated there is a huge stack of Health Department reports in the file that are disturbing. He added that the applicant and Mr. Mohammed are blaming the deceased owner, but he hasn't been the agent for quite some time. He stated that Mr. Super is the agent and so what the deceased father was doing is irrelevant. He stated the agent is not at the store and the future agent is the son of the previous owner. He stated it is like volunteers coming up and saying what they will do in the future. He recommended nonrenewal based on the Health Department reports. Claire Evers - Health Department explained the reports and Department the process. She stated a complaint was received from a neighbor about selling expired, moldy, and spoiled food and the complaint was verified. An investigation was conducted in October the day the complaint was received, and a reinspection in November. She added there was a routine inspection on March and 6 violations were observed, and a reinspection was conducted on April 9th. She explained the process of determining health grades for each premises, per the Milwaukee Code of Ordinances. She stated that if there was evidence of pests in food the premises would have been shut down immediately. She stated that the premises did not pose an eminent health risk because there was hot water to sanitize, no leaks in the roof, and no evidence of pests in food. She added that repeat violations do not allow you to earn your points back and people who are repeat offenders will be penalized. She stated there was spoiled food present in both the October and March inspections. Ald. Kovac stated in October there was a list of pretty bad things that was correct in November, and in March there was another list of bad things that was corrected in April, and they haven't been inspected since April. He asked what it takes to get a "B". He asked what it would take for the Department to close someone down right away during inspection. She stated that the applicant is the certified food manager and is he is gone someone else will have to be a certified food manager. He added that the pest control issue is the problem of the applicant and if the pest control company isn't doing their job, it's still the responsibility of the premises. Ald. Lewis asked who was in charge of the store during these violations. She asked Malik what qualifies him to be in compliance with the health code and run the premises. She stated she is concerned about the pest control and if the company isn't doing a good job, a new company should be hired. She stated that she is concerned because there doesn't seem to be an action plan to address the issues at the premises. She stated that the agent not being present at the premises is part of the problem. She added that there have been ongoing issues at the premises and they need time to get it together. Ald. Coggs asked if any of the violations from October were also present in March. She stated the stuff in the reports is nasty and visible, and why were the violations from October repeated in March, and how can the committee trust that these things won't keep happening. She added that there were things going on while Malik was in the store that should be obvious like the sight and smell of spoiled meat. She stated the solutions put forward by the applicant and Malik don't seem to be enough to abate the problems and prevent the sale of spoiled meat. Ald. Johnson asked the applicant how frequently he was in the store from January 2017 through October 2017. He asked how often the pest control company comes out. He stated the report identifies areas that need to be fixed. Ald. Witkowski stated he is concerned about the repeated violations over the course of several months. He added that this seems to be the normal course of business. He stated that it is a rarity for the Health Department to come in and testify and he is not convinced that the problems will be fixed. Nadine Katchever stated her husband gives people a chance and buys every resident gifts at Christmas. She added that her husband is constantly doing repairs to the buildings. Michael McKirmen 2424 W Kilbourn Ave stated it's a community and it's quite at night. He added there has been no prostitution or drug dealer in the last year. He stated the lawn and yards are clean. Kathy Fox stated she is the realtor representing the property and has received offers from all over the country.
