Maistelman said that given the issues in the police report, they have sat down with the staff to review all the procedures and that MPD has access to the surveillance system (passwords shared). Individuals also present: Ald. Dimitrijevic asked if this business was operating extended hours without license. Atty. Maistelman said that Ald. Dimitrijevic is right, that his client thought he had it as this premises was previously licensed for extended hours and that there are no items in the police report that occurred during that period. Ald. Dimitrijevic said that there are no items in the police report during that period of time but negative things happened around the neighborhood. Ald. Zamarripa noted that the Extended Hours license was just approved this January. There were no neighbors present to testify. Ald. Dimitrijevic said that there was some miscommunication between her office and the License Division, that she always checks with MPD too and that there were situations like people hanging out after hours when there was no extended hours license in place. The applicant said that the panhandling and loitering are also happening at the neighboring businesses and that he is working with them as well. Atty. Maistelman said that he recognizes that issues happened this last year but that his client did not have issues before. The applicant said that he has many customers who goes to the store during his break while working third shift. Ald. Dimitrijevic said that the issues started to happen recently and that she wonders if the applicant is considering to change the hours for the store and not for the pumps. Atty. Maistelman said that they are not willing to change the hours. Sgt. Velasquez said that no citations were issued for operating during the extended hours license. Ald. Dimitrijevic said that she does not understand why the applicant did not receive a citation for being open during extended hours without a license. Atty. Maistelman said that he was not prepared to talk about the extended hours licenses that was approved on January without any issues and that his client has not had any issues after hours. Individuals in opposition: Edwin Thawes – 710 S 3rd St – said that he has been a resident for 12 years and that this is not a misunderstanding, that the applicant has been holding events without the proper PEP license and the events exceed the volume levels even with the noise variance permits. He added that the speakers are outside and has photographs to prove it. Ald. Zamarripa asked the witness if he submitted the photos to the committee. Mr. Thawes answered “no”. Ald. Perez asked the witness if his objection is to special permits or to the business operations. Mr. Thawes said that the business has been operating without the PEP license before and that it is a concern to him because the business does not follow the City ordinances. Ald. Perez said that they are working on legislation for an acceptable decibel level even after receiving a noise variance permit. Ald. Perez asked what kind of follow up was given after Mr. Thawes’ complaints for the entertainment held without a license. Ms. Lopez said that Mr. Thawes was directed to call MPD as the License Division does not enforce the licenses. Mr. Voss said that he takes full responsibility for what has been done and that he is kind of new to the business (3 years) with the business there for 6 years and that he wants to take neighborhood input because he wants to be a good neighbor. Ald. Burgelis asked the applicant when he found out that he needed a PEP license for the activities that they hold. The applicant said that few months ago. Ald. Burgelis said that it is a problem for him that the applicant did not knew that he needed a PEP license when the neighbor let the applicant know many times before and applied after the fact and held events still. Ald. Perez said that he is disappointed and that he is trying to correct the situation but also wants to take Mr. Thawes' complaints seriously but that this is not a bar hours business. Ald. (Expires 6/19/2026) The applicant was present along with her husband Mr. Wang. Regarding the items in the police report, the applicant said that her staff handled them very well with getting the crowd out of the building and dispersing them. She said that the last incident happened after hours, the bar was closed, that the surveillance video was provided showing the security guard dispersing people earlier and that when the person returned, the security guard went out and did not go well. She said that her security guard came in to ask the bartender to call 911 and stayed next to victim until assistance showed up. Individuals in opposition: Asia Leach – 3323 N 22nd St – said that she is here on behalf of her brother and as a licenses social worker because her brother has a long term injury as a result of the assault, that she has reviewed the videos and that there is no way that the staff did what they were supposed to do, that the guard was not licensed and let her brother to die on the street. She noted that the applicant has only one security officer for the entire bar and that he was not wearing any uniforms, no badge, and that it is a serious failure according to Wisconsin Statue 440.2 and that establishments operating under 125 have an obligation to maintain order and protection for the health, welfare and safety of the patrons. Ms. Leach said that her brother might live in a care facility for the rest of his life and will use a feeding tube as a result of this lack of service. Mr. Wang said that the incident happened after bar closed and that the security guard asked her brother to leave. Individuals also present: Ald. Chambers said that we are here for item 8 in the police report which was a very unfortunate incident, which also led to charges filed against the assailant for the damages to the victim. He explained that he spoke to police captain and according to the footage provided, something happened between the victim and his companion that the victim did not like it, that there was some scuffing between the parties, that security escorted them out, that both left the establishment and the victim came back to the bar after it was closed. He added that this establishment was well ran for three years, that parameters will be put in place to be discussed with the applicant because this cannot happen again. Ald. The applicant said that he did not know that there was a hold on his license and that he closed the business after finding out about the hold, that he proceeded to do the proper diligence to get the hold removed before continuing operations. He added that there is nothing else in the police report that he wants to speak about. He also said that his business is good and growing. Individuals in opposition: Natasha Williams – said that she prefers not to give her address – explained that her problem is the amount of garbage without a receptacle, that there are rats everywhere and that she is tired of reporting this to the alderman’s office and to the applicant. She added that the applicant uses the alley to park vehicles and that she has to get out from her vehicle to ask them to remove the vehicles when she wants to get in her garage late at night. The applicant asked Ms. Williams why she did not go to yesterday’s meeting. Ms. Williams said that she had talked to him numerous times without a proper response. Stephanie Harling – Executive Director BID 31 – said that she has had conversations with the applicant regarding the trash, that she has offered assistance getting cameras in the alley and that there is lack of cooperation from the applicant. She added that she expects it to change today because this business has negatively affected the community. Individuals also present: Ald. Chambers said that he has had extensive conversations with the applicant prior to yesterday’s neighborhood meeting, that the applicant has made some changes to the plan of operations like getting a larger trash receptacle and having it picked up twice/wk. Ald. Brower moved to amend the plan of operations to include a larger trash receptacle (more than four cubic yards) and two pickups per week. There were no objections. Ald. Chambers recommended approval with a 20 (twenty) day suspension to rectify the issues that the applicant knows he needs to work on. The applicant said that this is his first business and that he works hard every day to do things better, that he does good deeds for the community and keeps communication open with Ald. Chambers.
