| 1 | 1. | Ordinance | A substitute ordinance relating to zoning regulations for family day care homes.
Minutes note: Chair Brengosz commented. A Proposed Substitute A version was before the committee for consideration and would amend the definition of family day care home to increase the limit of children being cared for from 8 to 12, which would bring the City's code into compliance with recent changes in Wisconsin State Statutes.
Member Richardson said that a long-standing drafting error had been discovered in Section 295-203 relating to use definitions, where the word "family" had been missing from "family day care center" for nearly 20 years, and the proposed substitute would correct that error.
Member Dobbs commented. State law specified that day care certifications were for a number of children not related to the provider. That language was not present in the City ordinance. There was an inconsistency in phrasing between the definition referring to a place licensed as a family day care center or certified as a day care center for not more than 12 children. The certificate of occupancy section would conflate County certification and apply only to places caring for a maximum of three children while State licensure was required for four or more children. The code had been functional in getting by despite the language inconsistency.
Member Richardson moved that Proposed Substitute A of the file meets the criteria of legality and enforceability, administrative efficiency, and consistency with the format of the code. Member Dobbs seconded. There was no objection.

| 1 | 2. | Ordinance | A substitute ordinance relating to notification by the board of zoning appeals of expired appeals.
Minutes note: Chair Brengosz commented. For considerations was a prospective Proposed Substitute that would remove the Licensing Division from the notification requirement so that only the local alder and the Department of Neighborhood Services would receive notification.
Member Dobbs commented. Clarity was needed on the phrase "zoning appeal expires" as defined in Ch. 295-311. There was no expiration for an appeal from an order or determination of the Department of Neighborhood Services. What typically expires was a Board of Zoning Appeals approval for a special use or a use variance granted for a set period of time. More specific language should be used, such as "zoning special use or variance expires" or "zoning approval expires" or specifying that it applies to special use permits and variances insofar as they expire.
Chair Brengosz said that she would work with the sponsor to propose and make the change.
Member Dobbs moved that the prospective Proposed Substitute, with the amendment to replace “zoning appeal expires’ with “zoning special use or variance expires” or “zoning approval expires” in Ch. 295-311, meets the criteria of legality and enforceability, administrative efficiency, and consistency with the format of the code. There was no objection.
