He added that this application was scheduled due this disconnection, for some objections on the food trucks and the bright flashing lights on the premises even when the establishment is closed. He said that he drove last night and the lights were flashing and the business was closed.
The applicant said that she placed colorful lights around the premises and that she will turn the lights off.
Ald. Burgelis moved to amend plan of operations to restrict flashing lights and no carnival lights after business closed. There were no objections.

Juan Hernandez - testified as store manager at Burger King on 1841 S 14th St. - said that he is in opposition for the parking, trash from customers, cars blocking entrances including to his business, loitering and customers cars with loud engines and music on the parking lot. He added that food truck operators do not ask customers not to do those things, that they leave broken bottles on the lot and the lack of cleaning after food trucks leave unless he is recording them. He said that he wants food trucks to move somewhere else.
Ald. Perez said that he has gotten several complaints about this situation and that PW and MPD are aware of and food trucks are not following up the 50ft rule and they still parking on Forest Home. He added that he is waiting for other departments to chip in.
Ald. Burgelis said that he is very disappointed hearing about these problems in another part of town and asked the applicant if it is true what Mr. Hernandez said and what she does to avoid issues there.
The applicant said that it is true, that she fills two extra-large bags every night and that she no longer will park there due the ongoing issues.
Ald. Burgelis noted that there is no itinerary on neither of the food peddler’s applications and that the committee should not consider incomplete applications.

Minutes note: 04 PESQUEIRA, Paresha SARA, Agent for "VICK'S ON VAN BUREN LLC", Class B Tavern, Public Entertainment Premises and Food Dealer Licenses Application Requesting Instrumental Musicians, Disc Jockey, Bands, Patrons Dancing, 4 Amusement Machines and Age Restriction 21+ After 9PM for "AVA'S ON VAN BUREN" at 1230 N VAN BUREN St.
The applicant was present with Mr. Kastenholz (property owner representative) and represented by Atty. Ovbiagele.
The police report was read.
Atty. Ovbiagele said that the item on the police report happened long time ago, that her client runs several successful businesses and taverns in town.
The applicant said that she is looking to have an american eatery spots bar with craft cocktails with all the games on from every sport. She added that she has 2 venues in the city and the last one opened 3 weeks ago in Ald. Bauman’s district as well.
Atty. Ovbiagele said that this is the old Victor’s building and same licenses were held.
Individuals in opposition:
Kendall Breunig - 10700 E Venture Dr, Franklin WI – said that he is a MSOE alumni, member of board and executive committee at MSOE. He added that the president could not be here today but that he is here to testify in opposition to this dance club going in. He mentioned that he is also an owner of 252 E Highland Av which he is redeveloping into 30 student apartment next to MSOE. He said that a dance club is a terrible idea for MSOE with 3,000 students on campus with 1,200 living in the immediate campus and 1,500 within 4 block from campus, and that this will squeeze MSOE between the problems on Water St and another dance club. He added that with 350 people going into that space, about 120 will drive there, that no traffic/parking impact studies have been done. He continued saying that when Victor’s was there, there was more parking in the area and that only about 40 cars will get a spot on the street.
Ald. Burgelis asked Mr. Breunig if he has parking spaces for those 30 apartments.
Mr. Breunig said that he has 120 parking spots and allows MSOE to use them while he is developing. He added that he has more parking spots than he needs for his tenants.
Responding to Atty. Ovbiagele’s questions Mr. Breunig said that he will need 60 spaces for the apartments and about 25 for the 4 commercial spaces, that his tenants are one pharmaceutical marketing business, a real estate company, a law firm and one radio station coming up, that he did not conduct a traffic study because he did not need one but MSOE did it, that he does not live in the area, that he is aware that Victor's was a Class B, that he never objected to the renewal and that his objection is to for the dance club, with 70% of alcohol sales, 7 days/wk, that he was not aware that the closing hours were amended to close 12AM Sun-Thu and at bar time on Fri-Sat but that it does not change his mind because the bar would still there. He also answered that he did not object to the bar across the street (1201 N Van Buren) and that he did not request a traffic impact study from that bar.
James - 1130 N Van Buren St #1 – said that he manages the Blackstone Apartments since 1986, that Victor’s was there already but it was also a bad neighborhood with drug usage and prostitution and that residents complained about patrons’ noise when leaving Victor’s because they stayed drinking, dancing and even firing guns on the parking lot. He added that he just accepted Victor’s as a bad neighbor but over the years, the neighborhood has changed, Victor is closed and the supermarket across the street closes at 10PM. He also said that traffic lanes have changed to slow down vehicles but it does not stop them from driving with loud music and the neighborhood is not a good fit anymore for this type of establishment surrounded by apartments with no commercial activity after 10PM.
Responding to Ald. Bauman’s questions, Mr. James said that there was a peak when things became progressively worse when Victor’s was super popular with people on TV talking about it and then COVID came and kill a lot of the clientele, the owners got old and the business was not there anymore, that he never objected to the license because Victor’s was there first but now it is gone, that he has been there longer than the current applicant and that his neighborhood has become more residential each year.
Atty. Ovbiagele as a point of clarification said that the alderman of the district is not part of the committee and should not make any questions; that he knows that it is a practice that has been done but that it is a point of order and clarification.
Ald. Zamarripa told Atty. Ovbiagele that he knows it is a standard practice that the local alder addresses the districts’ concerns.
Atty. Ovbiagele said that he just want to clarify that it is not allowed in the ordinance.
Atty. Gresham asked if he is objecting.
Atty. Ovbiagele said that he wants to object if it is allowed.
Atty. Gresham said that the local alder and the local concerns is the principal in this matter.
Atty. Ovbiagele’s objection was ruled.
Answering to Atty. Ovbiagele’s questions, Mr. James said that he does not own the salon, that he manages the building, that he has been at every bar in the neighborhood but there are nothing like Victor’s, that he has not objected to any bar before including Victor’s, that he was a patron of Victor’s, that he never filed a complaint because he knew the owners, the staff and the patrons and that he asked his neighbors to file the complaint or call the police themselves as he thought it was more appropriate. He added that he does not want another tavern there, that he wants an apartment building and that he has no concerns with Haven’s because there is not parking lot there.
Kristin Karcher - Kings Head Salon/Officer Manager - 1246 N Van Buren St – said that they have been there for 30 years, that they had a lot of vandalism when Victor’s was there, the parking lot was constantly broke in with graffiti on the walls, smashed cars, stolen cars and that they do not want another business like that.
Responding to Ald. Bauman’s questions, Ms. Karcher said that she has been working there for 30 years, that never objected to Victor’s renewal because the salon’s owner and Victor’s owner were friends, that the hair salon and Victor’s started operations with a year apart, that the neighborhood changed with more aggressive patrons the last 10 years, that they are in opposition of any sort of tavern at this location and that they have not been contacted by the applicant neither her attorney.
Atty. Ovbiagele objected to Ald. Bauman’s line of questions because he is testifying and the ordinance does not allow that.
Responding to Atty. Ovbiagele’s questions Ms. Karcher said that she did not object to the bar across the street, that she did not object to any bar in the area, that she did not file a formal complaint during Victor’s time, that she became a manager 20 years ago, that the salon owner would talked to Victor’s owner about any issues, that sometimes were resolved and their business hours are Mon-Sat, 8am-8pm, that she never saw firsthand any of the issues but that they have surveillance cameras in all sides of the building including Victor’s parking lot because they were allowed to park there during the day and that she believes they file a police report once, had the police coming in for that or something else once and that they haven’t had any issues since Victor’s closed.
Tony Fortune – 709 E Juneau #400 – said that he lived at 777 N Van Buren and left because every night was a nightmare with rowdy people, having sex in their cars and moved back after the Victor’s closed because the neighborhood changed and the building is beautiful. He said that he would like to see a restaurant bar that closes at 10pm, that picks up garbage around and is a good neighbor overall.
Answering to Atty. Ovbiagele’s questions, Mr. Fortune said that he lived there in 1991 and 1992, that he moved out to State St because he no longer could stomach living by Victor’s parking lot, that this business is going to be exactly what Victor’s was (read the neighborhood notice for this hearing), that he felt safer with prostitutes and drug dealers at State St than at Victor’s, that he does not hear noise from the business across the street and that he was not approached by the applicant.
Andy Kaid - 709 E Juneau #206 – said that he has lived there for 15 years and that he has safety and noise concerns, that the noise echoes with the buildings around, that windows shake with the loud music, that they could not sleep for years, that with Victor’s closed there are no more fights and he has not been woke up by shots being fired. He added that the peace is back and asked the committee to consider the safety and peace as well.
Responding to Ald. Bauman’s questions, Mr. Kaid said that he never filed an objection or police report against Victor’s because he thought that it was a just a bad neighbor, an institution for decades and gave up the possibility, that the neighborhood has improved substantially since Victor’s closed .
Answering to Atty. Ovbiagele’s questions, Mr. Kaid said that he moved to downtown for school and stayed there, that he is used to bar noise, noise on the street, that it is funny to watch a fight break up between stupid drunks but that Victor’s was a different beast, that he does not know how to describe it. He added that he was not aware of the change of hours, that the issues did not happen Sun to Thu but on Fridays and Saturdays, that Haven is a different vibe, that Victor’s is a different thing with a dance floor and lights coming into his apartment, that he was not aware of the type of entertainment that Haven has but that it is a place for café and brunch, that he cannot compare both establishments in terms of space and installations, that he wants to keep his peace now that Victor's is closed and that there are shootings in other parts of town without a dance floor as well.
Rene Horward-Paez – President St Joan Atida High School – said that this is one of the two schools within walking distance from the proposed establishment, that they serve 200 young woman from all over the city, that they have a convent within the building with 5-6 catholic sisters in their 60’s living there, that he is here representing the interest of the school and the sisters, that Van Buren is already a mess with the lane’s reduction and bike lanes, that it is hard to turn, same for the school buses, with basketball and volleyball games in the evening, that the concessions stand have been renovated, that they are becoming a community center for the neighborhood, that they have concerns about the traffic, the lack of parking and security. He added that he was at the meeting, that he was not approached by the applicant and there was a lack of professionalism on both ends but tried to get something back of how things could have been different if they were approached first. He also said that they work with teenage girls and that their safety is their major concern, that some after school programs and buses run late at night as well. He said that he has been in this position since two years ago and that it has been quiet without since Victor’s closed.
Responding to Ald. Bauman’s questions, Mr. Horward-Paez said that the organization is in opposition of any Class B Tavern at this location.
Answering to Atty. Ovbiagele’s questions, Mr. Howard-Paez said that he cannot speak about if the school objected to Victor’s license, that he has been in that position for 2 years, same years that Victor’s has been closed, that he is here doing diligences for what is opening now, that Havens is closed every time that he tried to eat there, that there is no much action at Haven’s, that classes end at 3:10 pm with last call for buses at 3:30 pm, that students come back later for competences, that the main concern is parking, foot traffic and alcohol around a residential area, that he is here to speak about what could wrong, that they prefer not to have that nature of business around, that the school has been there for 70 years in the same building, that the school opens weekend for other activities.
Joe Spasiano – 1325 N Van Buren #503 – read a statement about Victor’s as neighbors, that they have lived there for 20 years, that Victor’s has been a constant issue, that the noise was intolerable with drunks patrons going on streets at 2:30am screaming and blocking traffic causing disruption, that they used to call Victor’s for the ongoing issues but they claimed that they have no responsibility once people left the premises, that they contacted the police several times and often came 2-3 hours later after the noise has subsided. He added that the lanes have been reduced to one on each direction, that there will be a traffic jam of vehicles trying to drop up/pick up patrons and that for the first time in so many years, they can sleep in their apartment with the windows open.
Responding to Ald. Bauman’s questions, Mr. Spasiano said that he never came to one of Victor’s hearing renewals, that he used to complain directly to Victor and sent emails to Ald. Bauman.
Ald. Bauman said that it is true.
Answering to Atty. Ovbiagele’s questions, Mr. Spasiano said that he did not know that there will be a designated area for ride shares, that it would alleviate that concern but the noise is his major concern and that he does not think that they can monitor behaviors of 20 people screaming, jumping and fighting at the same time.
Rebecca Spasiano - 1325 N Van Buren #503 – said that the neighborhood is residential and that with this business the neighborhood will go down, that they support restaurants but this place with a capacity of 350 with very few parking spots, will be crazy because it is not an easy area to drive around.
Steve Williams – 1025 N Broadway – MSOE Campus Infrastructure Vice President – said that MSOE opposes to a high capacity venue like Victor’s trying to maintain the safety and security of the 3,000 students who live within and around MSOE. He added that there is an increase of criminal activity and threats to students with high capacity venues.
Answering to Atty. Ovbiagele’s questions, Mr. Williams said that he has hold the position for 5 years, that he has not filed an objection against Victor’s but they have spoken to Ald. Bauman on repeated occasions about how to make the campus safer, that he was made aware of this application by Kendall Breunig, that Victor's legal capacity is 450, that Havne's Café is a much smaller in size and that he has been there as well, that he did not objected to Haven’s Café for the size of the space, that he knows that Haven's Café has a Public Entertainment License and that they do not charge cover.
Joey Wisniewski - 1848 N Farwell Av – Representing New Land Enterprises – said that New Land is a community based multifamily mix use developer in Milwaukee, that they managed 2,300 units in the area, that they know and to run and occupy spaces and that none of their commercial spaces are vape shops, convenience stores or national brands, that they support small businesses, local operators, that this application wants to keep night club hours and based on the meeting that was held, only one of the partners has experience in the industry, that the applicant lied about having a license suspended when he asked her directly and that he does not think that this is the right type of business or operation that will benefit the neighborhood. He added that he is here to talk about how much the neighborhood has evolved since Victor’s left, that private and public investment has been substantial on Van Buren, that is one of the most pedestrian and bike safe streets, that more housing and solid operators has been a great benefit to the city. He also said that at the meeting the applicant said that they want to hear from the property owners, that they are the property owners and that he has not heard from the applicant or her counsel since that meeting about ways to improve the business plan, ways to collaborate and that the Class B Tavern and PEP license it is a privilege that the applicant has not earned yet..
Ald. Burgelis asked if New Land is interested in purchasing the property.
Mr. Wisniewski said that the site do not meet their interests.
Responding to Ald. Bauman’s questions, Mr. Wisniewski said that NOVA is a 9 story building with 259 units and 11-13 townhomes on the ground level facing the applicant’s property, that they have developed other properties within the vicinity, that New Land has been 30 years in the city, that he has been 10 years here and that there has been a good evolution in certain areas of the city.
Atty. Ovbiagele objected to the last comment and said that Ald. Bauman is leading the witness to testify.
Ald. Bauman continued, Mr. Wisniweski said that the area has evolved into a residential area, that Haven’s Café is approximately 1,700 sq ft with 10 tabletops and larger cafeteria tables for groups.
Answering to Atty. Ovbiagele’s questions, Mr. Wisniewski said that after the meeting any of applicants should have contacted them to discuss the business plan and any objections that they might have also with any other condo association or school in the neighborhood. He also said that the original application was discussed at the meeting, but nor further communication came after the meeting, that he was not aware that Atty. Ovbiagele requested the roster, that he knew that there was an amendment on file when the applicant asked to be adjourned from the second hearing and that he was not aware that Ald. Bauman said that it was not necessary to hold a second neighborhood meeting. He also said that he was not aware that Haven’s Café did not have a hearing, that he was not part of the application process, that he is aware of the type of licenses that Haven’s Café has and that all are before 11pm on Fri & Sat and 10pm or earlier the rest of the week.
Tammy Buckhorst – East Town Association Executive Director – said that she facilitated the neighborhood meeting requested by the applicant and her attorney, that a second meeting was requested by Atty. Ovbiagele, that she told him that she needed more details in order to help and that things have gone in different direction since then. She added that the expectation for any business coming in the neighborhood is to listen to the neighbors, local alder and the licenses committee.
Responding to Ald. Bauman’s questions, Ms. Buckhorst said that she hosted the meeting with 25 attendees with no one in support, that she did not poll anyone, that there was a roster that became property of the association, that separate clipboards were passed around, that she does not know if everyone signed up and that when gets a request to share that information, she first asks the attendees if they want to share their information.
Ald. Pratt asked if the roster was passed around like in a public meeting.
Ms. Buckhorst said that it was but it did not say that the information was going to be shared with the applicant or the City.
Ald. Bauman asked if most of the major stakeholders presents here were present at the meeting.
Ms. Bockhorst said that MSOE, New Land and St. John Antida were present.
Atty. Ovbiagele objected to the last question.
Atty. Ovbiagele said that Ms. Buckhorst testified that there were about 20-25 attendees and asked if about 10 were actual residents.
Ms. Bockhorst said that she will need to look at her notes.
Chris Dillion – 728 E Juneau Av – said that they share a property line with this proposed business and they have expressed the concerns about the use given the prior history of the site and that they would not oppose to a restaurant bar. He added that there will be 29 apartments facing the parking lot.
Atty. Gresham advised the committee to open Ald. Bauman to cross in order to address Atty. Ovbiagele’s objections only.
Ald. Bauman responded to Atty.Ovbiagele’s questions:
Ald. Bauman said that there is no version of a tavern that he will support at that location, that he reached to the neighborhood association to host the meeting, that he did not reach out to Atty. Maistelman, Atty. Halbrooks and Mr. Peterson, that he reached out neighbors through a postcard notice that was mailed out as customary, that mailing postcards depends on the application, that he does not do it everytime, that the application was held for a neighborhood meeting at the hearing, he does not recall meeting with the applicant the day before the first hearing, that he believes he met with them once but do not recall the time, that he does not recall if he said that he wanted to have a neighborhood meeting, that he asked Licenses Committee not to schedule this application until the last cycle possible, that he does not recall his client asking for a neighborhood meeting, that he decided to schedule his own neighborhood meeting, that he does not know when was the last time that he scheduled a neighborhood meeting, that at the meeting he expressed very clear his position about having a bar there, that he has been in office for 22 years and never moved for revocation, never advocated for suspension because there were no PA33s and/or complaints on file to trigger a hearing and much less to move for a nonrenewal because there was not enough evidence that they could rely on to not to renew a property protected due process but that this a new license with no due process and no property rights.
Atty. Ovbiagele said that Ald. Bauman delayed the application after the neighborhood meeting.
Ald. Bauman said that he delayed the application because it had red flags since the beginning, that the first application indicated that the applicant owned the property, which it was false and needed to be tracked down, that the License Division sent a letter to the applicant to prove that she had interest on the property and that another person contacted him identifying himself as the property owner.
Atty. Ovbiagele objected to Ald. Bauman’s explanation.
Ald. Bauman said that the agent is not the tenant, that it is another LLC who owns it, that the registered agent is the brother of the person here present and that he decided that he was not going to committee until have all these issues sorted out. He added that after the License Division sent the letter and amendment was received with the applicant listed just as the agent but that it took 2 months to accomplish. He also said that an explanation was received saying that the paralegal made a mistake filling out the application that the agent signed it.
Atty. Ovbiagele asked Ald. Bauman if he gets too involved to figure out who is the property owner with other applications.
Ald. Bauman said that most of the applicants are very straightforward but that he gets involved when he has been lied to and there is deceive for fraud.
Atty. Ovbiagele asked Ald. Bauman who made him aware that he was been lied to.
Ald. Bauman said that it was at a neighborhood meeting involving Allure and that Atty. Obviagele's client to his right raised his hand saying that he had purchased Victor’s, that he took it at face value but the owner of Taylor’s approached him saying that he was not sure about that statement because his next door neighbor told him that he purchased Victor’s and that he would have his neighbor to call him to verify the information, that the neighbir called him saying that he owned the property and that he does not remember the name right now.
Atty. Gresham said that Atty. Ovbiagele is asking Ald. Bauman to speculate but objecting to hearsay when Atty. Ovbiagele asked Ald. Bauman if the property owner who called him purchased the property under his name.
Atty. Gresham also noted that the ordinance dictates a 30 minutes hearing and that we are past 2 hours and asked Atty. Ovbiagele to move forward.
Atty. Ovbiagele asked Ald. Bauman to confirm that they requested a second meeting.
Ald. Bauman said that he requested the roster and that he responded that A: he did not even know that there was a roster, B: that he doubted that everyone signed and that frankly, with 100% of opposition he did not see how they could accomplish something, that he did it see it as a productive.
Atty. Ovbiagele read an email sent by Ald. Bauman for the record.
Ald. Bauman said that is exactly what he explained previously.
Atty. Ovbiagele asked if after that email an amendment was received.
Ald. Bauman said that one amendment was received with minor changes like trade name.
Atty. Ovbiagele asked Ald. Bauman if he reached to the applicant after the amendment was received to provide any feedback.
Ald. Bauman replied “no”.
Ald. Zamarripa said that the applicant stated that it is going to be sports bar and asked her if she has considered amending the Public Entertainment Premises application to truly reflect a sports bar.
Atty. Ovbiagele said that if the alder said that he does not want to see a bar there, there are no modifications that would give a peace to folks in objection. He added that the neighbors present here (the couple) were very amenable, that institutional stakeholders are a little different because those positions come from the board, that the true to the matter is that is not going to be a night club but a sports bar and that a lot of sports bars have the same exact licenses. He added that he has been at Haven’s Café and it has the same licenses as his client is requesting and that this is a shifting standard. He also said that his client is open to make changes but they have to make sense.
Ald. Brower asked if they are willing to close earlier.
Atty. Ovbiagele said that the amendment sent has the closing hours at 12AM Sun-Wed, 1AM Thu and 2:30AM Fri & Sat.
Ald. Bauman said that this has gotten off the tracks and that he does not want to see a tavern there because the neighborhood has fundamentally changed in 60 years. He added that when Victor’s was built and opened for business, the area was an urban renewal wasteland, that Victor’s was an established business with property rights that could not be moved away due the neighborhood changing. He continued saying that Victor’s has closed, that we have heard testimony of how the neighborhood has changed substantially since then and that it is such a residential area, that it is zoned now as a high density residential area C9G and read part of the definition for the record. He also said that looking at the C9A table, a tavern is a special use which requires a Board Zoning Appeals action to get occupancy.
Atty. Gresham said that they have not applied for BOZA yet and that there is an objection stating that they should not have to appear before BOZA because the application was filed within 12 months after Victor's closed.
Atty. Ovbigele said that this is a naked display of aldermanic privilege and that since the beginning of this process, Ald. Bauman has been disrespectful to his client and he as well, that he is sick and tired of him thinking that he has an upper hand, that he finds him racist and sexist on most of his dealings with him. He added that Ald. Bauman purposely orchestrated to put them in this situation where the license was not going to be heard within 1 year so he could have multiple prongs to attack. He added that Ald. Bauman does not like his client and he does not want them in his district.
Ald. Burgelis moved approval.
Ald. Zamarripa said that moving to a motion without a little discussion is very unfortunately and that she appreciates the passion but that the application was held one or twice at the request of the applicant, that she heard Atty. Ovbiagele’s concerns, that very good points were made and that she is conflicted now because she did not heard the applicant asking neighbors what they would like to see neither showed more compromise making a couple of amendments.
Atty. Ovbiagele asked the committee if they could pull out of committee to hear an amendment.
The Chair agreed.
Atty. Ovbiagele said that they are willing to remove the patrons dancing which is perceived as a nightclub component.
Ald. Zamarripa asked why they not remove the Disc Jockey as well.
Atty. Ovbiagele said that they need the disc jockey as part of the plan otherwise they will need to play their own music through the speakers.
Ald. Burgelis moved to amend the plan of operations by removing patrons dancing as a type of entertainment. There were no objections.
Ald. Zamarripa said that Ald. Brower questioned around amending hours.
Atty. Ovbiagele said that they are willing to amend the plan of operations to have the alcohol cut off at 1:30AM on Fridays and Saturdays but to sell food until 2AM.
Ald. Burgelis moved to amend the plan of operations to cut alcohol at 1:30AM on Fridays and Saturdays and to close at 2AM Fri-Sat. There were no objections.
Ald. Burgelis moved approval as amended.
The motion failed (2-2-1).
