| | 2. | | The Board may convene into closed session pursuant to s. 19.85(1)(h), Wis. Stats., to consider and render confidential advice. The Board will then convene into open session as authorized by s. 19.85(2), Wis. Stats. to continue with the remainder of the agenda.

| | 3. | | Report from staff relating to office activities of the previous month.
Minutes note: Yadira Melendez gave the following report:
-No time yet to complete the 2023 Activities Report.
-About 250 SEIs have been received so far. A second reminder will be sent this week with the late fee amount if not filed on time.
-On January 31, 2024 Oscar Tovar (Mayor’s) sent a communication saying that the Boards Team will discuss the reappointments soon.
Peter Block gave the following report:
-The Milwaukee Bar Association has sent e-mails requesting volunteers to serve in the Ethics Board.
-Rolls and procedures a very outdated so he is going to bring proposals before the board and asked the members to let him know if there is something that they want to look a too.

| | 4. | | Discussion of next steps in investigation of Mr. Ohiku authorized at January 17, 2024 meeting.
Minutes note: Mr. Kruse said that the next step is to determine the action that the board can take to request Mr. Ohiku's tax returns for the years 2020, 2021 and 2022, how the board wants to approach the investigation and to explore the courses of action.
Mr. Kalscheur said that the documents can be redacted (personal information and ssn) and that there is one caveat: income for a $1,000 is not required to be reported on the SEI.
Mr. Kruse said that it is not necessary to hire an expert based on that it is a very straight forward request.
Mr. Kalscheur said that the board will need to hire someone to take care of the conclusions and findings if there is a violation.
Mr. Kalscheur made the motion to request copies of the individual tax returns of Mr. Ohiku for the years 2020, 2021 and 2022 with the personal information redacted based on 303.21.1. The motion was seconded by Mr. Nicholas. There were no objections.
Mr. Block has recused himself from this item but he was asked if any other staff member from the OCA could help.
Mr. Block said that it is difficult because Mr. Ohiku is the deputy attorney and has jurisdiction on all of the assistant attorneys.
Mr. Kruse said that he has experience in drafting subpeonas but that he will check if there is any conflict on interest.
Mr. Kalscheur said that a request can be made to the DOR for the state return that comes with the copy of the federal tax return based on 303.21.2
Mr. Kalscheur withdrew the previous motion and moved to request the DOR a copy of Mr. Ohiku's state tax returns for the years 2020, 2021 and 2022 based on 303.21.2. Mr. Nicholas withdrew his previous motion and seconded this one. There were no objections.
Mr. Kruse and Mr. Kalscheur said that they will work with the staff assistant to get the request out. | | | |
