Resolution approving a lease between the Redevelopment Authority of the City of Milwaukee and T-Mobile Central, LLC for a portion of the property at 3533 North 27th Street in the Century City Project Area, in the 7th Aldermanic District.
Analysis
This resolution will permit the Redevelopment Authority to lease said land according to the conditions in a Land Disposition Report.
Body
Whereas, In December 2009, the Redevelopment Authority of the City of Milwaukee (“Authority”) acquired a major portion of the former Tower Automotive facility, including the property at 3533 North 27th Street, for development of the Century City business park; and

Whereas, The Authority’s property acquisition included assignment of an existing lease with T-Mobile Central, LLC (as successor to VoiceStream) for approximately 200 square feet on the roof of Building 65 at 3533 North 27th Street for operation of a cell tower; and

Whereas, Due to limited electrical service and remediation activities being conducted in the project area, the cell tower should be relocated to a different portion of the Century City site; and

Whereas, T-Mobile Central, LLC has agreed to terminate its existing lease on Building 65 and to lease a different portion of the property at 3533 North 27th Street on a long-term basis to construct a free-standing transmission tower that will not interfere with other Century City activities; and

Whereas, The City Attorney’s office has negotiated a Cell Facility Lease Agreement with T-Mobile Central, LLC that allows T-Mobile to sublease space on its new tower and to share any sublease rent on a 50-50 basis with the Authority and that releases the Authority from the prior lease and any relocation obligations under Section 32.19, Wisconsin Statutes; and

Whereas, The Authority conducted a public hearing on the proposed lease on August 19, 2010, as required by Wisconsin Statutes; and
