TITLE
Resolution authorizing the Commissioner of Public Works to enter into an Out-of-Program Agreement with Marquette University for the relocation of a water main in conjunction with reconstructing and streetscaping a street abutting the new Marquette University Law School Building.
ANALYSIS
This resolution authorizes the Commissioner of Public Works to execute an Out-of-Program Agreement on behalf of the City of Milwaukee between Marquette University and the City of Milwaukee. This agreement pertains to the relocation of a water main project. This project is a result of a streetscaping project.
BODY
Whereas, Marquette University is constructing a new Law School Building located at 1215 West Michigan Street; and

Whereas, In conjunction with the building construction, Marquette University is reconstructing the street abutting the new building, (location is more particularly described by Exhibit “?”); and

Whereas, A City of Milwaukee water main is located within the limits of the above mentioned street; and

Whereas, The proposed elevation of the street is significantly lower than current elevation which requires the water main to be lowered; and

Whereas, The cost of the relocation of the water main will be funded entirely by Marquette University, cost to include construction costs, material costs, and engineering and inspections costs; and

Whereas, The project is on a very aggressive schedule which requires the construction of all proposed City and private utilities to start in January of 2008, and the roadway construction during the 2009 construction season; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the Out-of-Program Agreement attached to this file is hereby approved and the proper City officers are hereby authorized to execute said agreement on behalf of the City; and, be it
