Title
Substitute resolution reclassifying certain ARPA program expenses as revenue replacement.

Analysis
This resolution authorizes the Department of Administration to reclassify and reallocate certain previously allocated portions of the City’s American Rescue Plan Act (ARPA) funding as “revenue replacement” to minimize the use of 2022 contingent borrowing, and to insure maximum compliance with the U.S. Department of Treasury’s ARPA regulations.

Body
Whereas, the Common Council has allocated portions of the City’s ARPA funding to various projects since the passage of the American Rescue Plan Act in March, 2021; and

Whereas, the guidance from Treasury has evolved over that time, as has the City’s assessment of the portion of its ARPA allocation that may be designated as “revenue replacement” and the City’s understanding of the requirements of its various ARPA-funded programs; and

Whereas, funds designated as “revenue replacement” are not subject to certain restrictions of the federal uniform guidance and Treasury guidance that apply to ARPA funds that are not designated as “revenue replacement,” and may generally be used for programs and expenses for which the City would ordinarily expend its general funds; and

Whereas, reclassifying certain ARPA allocations as “revenue replacement” funds and reallocating certain program funds among projects previously authorized by the Common Council will decrease the City’s need to rely on 2022 contingent borrowing, and will insure maximum compliance with the Treasury’s ARPA regulations; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the Department of Administration, Budget and Management Division or other appropriate department is authorized to reclassify and reallocate certain ARPA funds set forth in Exhibit A to this resolution; and, be it
