Analysis
This resolution authorizes an easement for the Metropolitan Sewerage District South Shore Forced Main located on City-owned properties at 415 East Bay Street, 515 East Bay Street, 615 East Bay Street and 715 East Bay Street.
Body
Whereas, Milwaukee Metropolitan Sewerage District (“MMSD”) is requesting a permanent easement (“Easement”) on the City-owned properties at 415 East Bay Street, 515 East Bay Street, 615 East Bay Street and 715 East Bay Street (“Properties”); and

Whereas, The Easement will document MMSD’s rights, as well as the location of its South Shore Forced Main (“SSFM”) existing on the Properties; and

Whereas, The SSFM was constructed in 1989 as part of the deep tunnel project and was believed to be located in the right-of-way on East Bay Street; and

Whereas, The SSFM is no longer in the street right-of- way; and

Whereas, To clarify property rights and document the location of MMSD’s SSFM, an easement is recommended; and

Whereas, A copy of the Easement, survey and related map is attached to this Common Council File; and

Whereas, No compensation will be paid for the easement that benefits the City and MMSD users; and

Whereas, The Department of City Development (“DCD”), Department of Public Works and City Attorney’s Office reviewed the proposed documents; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the easement for Milwaukee Metropolitan Sewerage District on the City-owned properties at 415 East Bay Street, 515 East Bay Street, 615 East Bay Street and 715 East Bay Street is approved; and, be it
