Title
Substitute Resolution authorizing settlement of claims in the lawsuit entitled Hadrian, et al. v. City of Milwaukee in the amount of $900,000 and appropriating funds for this purpose.
Analysis
This Resolution authorizes a settlement payment in the lawsuit Jeffrey Hadrian, Thomas Flock, Effrain “Frank” Herrera, Richard Lesniewski, Hattie Nichols, Sandra Poniewaz and Jeffrey Watts v. Alfonso Morales and City of Milwaukee, United States District Court, Eastern District of Wisconsin, Case No. 21CV219, in the amount of $900,000.
Body
Whereas, The Plaintiffs, Jeffrey Hadrian et al., filed a lawsuit against the City of Milwaukee and Alfonso Morales seeking compensatory damages to which they alleged they were entitled; and
Whereas, The Plaintiffs have agreed to settle their claims against the City of Milwaukee and Alfonso Morales through a settlement agreement providing for payment of the total amount of $900,000; and
Whereas, The City Attorney recommends and the Common Council of the City of Milwaukee deems it expeditious and just to pay a settlement of the claims against it in this lawsuit; now, therefore, be it
Resolved, By The Common Council of the City of Milwaukee, that $900,000 shall be reserved and appropriated from the 2022 Common Council Contingent Fund (001-990-C001-006300) (2022) to the following funds and accounts:
1. $900,000 to the Damages & Claims Fund SPA (0001-1490-0001-S118-006300)
; and, be it
Further Resolved, That those funds are to be utilized to issue the following checks to be delivered to the appropriate persons in compliance with the settlement agreement:
1. $540,000.00 payable to “Hansen Reynolds LLC Client Trust Account”
2. $360,000.00 payable to “Hansen Reynolds LLC”
; and, be it
Further Resolved, That The City Comptroller and other appropriate City officials are directed to take all actions necessary to fulfill the intent of this resolution.
