Whereas, The matter of Jeffrey Becker v. Dane County, Appeal Number 2021AP001343, currently pending before the Wisconsin Supreme Court, relates to the authority of local health officers to issue health orders to combat communicable diseases under s. 252.03, Wis. Stats.; and
Whereas, Removing the authority of health officers to issue orders without needing to go to the local governing body prior to doing so would have wide-ranging negative consequences; and
Whereas, The authority vested in health officers is essential to the practical need to act swiftly and nimbly to deal with a variety of communicable diseases; and
Whereas, Local health boards previously held the authority that is now vested with the local health officer, and that was changed several years ago to expedite the ability to react to the emergence of communicable diseases; and
Whereas, The attorney representing Dane County / Madison has requested the City of Milwaukee’s assistance with filing an amicus brief (amicus curiae); and
Whereas, The Commissioner of Health is in support of filing an amicus brief (amicus curiae in this matter; now, therefore, be it
Resolved, By the Common Council of the City Milwaukee, that the Office of the City Attorney is authorized to file an amicus brief (amicus curiae) in the matter of Jeffrey Becker v. Dane County, 2021AP001343.
