Minutes note: 07 RAY, SR, Michael, Agent for "Michael Ray Gents Plus LLC", Class B Tavern and Public Entertainment Premises License Renewal Applications for "Gold Diggers Milw" at 4750 N HOPKINS St. (Expired 11/23/2021) Mr. Ray was present in the room along with Atty. Maistelman who appeared virtually and said that his client was fully cooperative with the police regarding the robbery item on the police report. Individuals also present: Ald. Coggs said that the reason to have this special meeting was to have the neighbor to provide a context of the videos available. Atty. Maistelman said that he objected to watch the videos without the neighbor being present and providing the narrative and that under the rules of evidence, technically the person who took the video must be here to provide the narrative. Atty. McNally said that this was an opportunity for Ms.Cleveland to appear and authenticate those videos herself and that the alderman who also have sent the same videos as apart of the objection has had an opportunity to review them so it is safe to play the videos for the sake of the community and to understand this license application. Ald. Coggs wanted to clarify that for years we have seen videos without the person who took it being present and that it has not been an issue in the past. Also asked Ald. Rainey how does he want to proceed. Ald. Rainey said that he wants to watch the videos do they can speak by themselves. Mr. Ray said that those cars on the video do not come from his establishment and that there are two apartment buildings next to it. Ald. Coggs asked Mr. Ray if he has cameras on the rear. Mr. Ray said that he does but they are pointing at the rear door. Ald. Coggs asked if we have the video that the neighbor mentioned about the gun fire. Mr. Ray said that it is an open field next to his place and that there were people shooting fireworks but that it was not him and that the police have access to the surveillance videos without him being present. Added that if there were complaints the police could have come and watch the cameras and that anyone that he knows would not be comfortable shooting a gun in front of a camera and said that the police can come to check his cameras to see if the person shooting is related to his business. Ald. Rainey said that it is hard to come up with a decision without the narrative or the feeling of what was going at the moment because we do not know where this people come from but that there is an issue with a neighbor and said that he will work along with the applicant to see what they can do with city vacant lot and to move forward with this application. Ald. Perez and Ald. Borkowski agreed that no more videos are necessary. Ald. Coggs said to the applicant that it is true that we cannot determinate if that people came out or not from his business but that there is a neighbor with an issue and that he has to work on those issues to run a successful business and that he must take these concerns seriously so we are not back here next year with a hundred videos and the neighbor. Atty. Maistelman said that his client has been open and cooperative and that he was here to address the issues and that we cannot tie what we see on the videos with the business. Ald. Perez moved renewal with a warning letter and said that it is very important that neighbors come forward and take the time to get involved. (Prevailed 4-0)

Added that this business must be a partner with the community because of the critical location. Rupinder Mann (husband) said that they have a couple of incidents every month and that they cooperate with MPD and that those two employees were let go back in September 28th. Added that he does not know if the employees were involved in the incident because they even closed the store that day and said that the neighbors also complained about the employees as well. Mr. Mann said that they have a very good quality surveillance system. Ald. Zamarripa said that she wanted to confirm that they have terminated the employment of the two individuals cited on the police report. Mr. Mann confirmed the termination. Ald. Zamarripa recommended renewal with a warning letter and she wants to make sure that Mr. Mann understands his commitment to the neighborhood. Ald. (Expired 11/28/2021) The applicant was present and said that she was not working at "La Caleta" but her brother and partner went to the MPD offices to fill out some papers and she was told that everything was fixed. Individuals also present: Ald. Coggs asked Ms. Hernandez if she had an explanation for the items on the police report specifically. Ms. Hernandez said that her partner is working to keep the place safe, tried to add more cameras and more security, woking in everything and always cooperating with showing the footage of the cameras. Ald. Borkowski noted that five incidents on 2021 occurred within three months and that he is concerned and curious about the alderperson's opinion. Ald. Zamarripa said that she is concerned about this business and that she called District 2 to do a further research on the premises and said that a total six shot spotter police reports have come out from this address and nothing has been done even after the police requested a new public safety plan. Added that they are all disturbing incidents including one patron being robbed after he left the bar and when the patron tried to get some help at the bar, the bar closed the door on him. The applicant said that she has owned the building for six years and used to rent it and that she had a lot of problems with the previous tenant (named Jose Luis) and that her partner who lives above the bar now, has bought the building now. Added that the previous tenant had minors living upstairs and that herself called the police because the neighbors reported that they were stealing stuff from cars. Said that after her partner bought the building they started to work on fixing everything. Ald. Perez wanted to verify for how long has owned the building and how long it took to get rid of the tenants. The applicant said that six months ago and that within a month they got rid of tenants. The applicant also said that she hopes that she gets a chance to fix this because some people rely on these jobs and that she will keep it as a family business. Ald. Zamarripa said that she appreciated the context that the applicant provided. and asked the applicant if they are still serving food. Added that she was unaware that the applicant bought the building and asked why she did not take the chance to resubmit a new public safety plan when MPD offered it. The applicant said that they still serving food and that she was busy with her baby's birth and she was told by her brother and partner that they took care of it. Ald. Zamarripa thanked the applicant for investing in the district and asked her for a meeting to discuss these shot spotter calls from this location and that she is willing to reconsider in renewing the licenses with a 2 week suspension in order and her desire to put together a public safety plan. Ald. Perez moved renewal with a 14 day suspension based on police report, aldermanic and applicant testimony. (Prevailed 5-0) Ald. Coggs said to the applicant the she hopes that she uses the 14 days suspension to come up with a public safety plan.

Bauman said that he has issues with the business plan because it is almost the same business model as before and that the noise emanating from the Riverwalk patio is the main concern and creates some conflict with the neighbors. Added that there are residential buildings where noise is a sensitive subject and wants to hear from the applicant how is he going to address the condominium owners complaints. The applicant said that his purpose is to enhance and beautify the area and that they have reached the condo association and have had a conversation with the board. Added that they have received a great feedback because they are not running a night club or a bar but private events only where the peak season will be during the summer until mid October. Bauman said that he wanted to be very clear that he supports the license today but that he does not want to hear noise complaints from residents and from brides for not following contracts because he won't support the renewal. (Expires 2/8/2022) The applicant was present along with Obi Obiora who is the agent for the food license. Mr. Obiora said that there is a miscommunication regarding the item number 2 on the police report because he was not aware of that someone was shot and later after reviewing the videos with the police they saw that the person who got shot left the scene and went to the hospital so he had no clue. The police got the phone call from the hospital that someone was shot. Added that he has hired an armed guard to be at the front door to avoid this type of incidents that actually was a scare for themselves as well. Ald. Perez asked if that was the response to the item on the police report that he was not cooperative with the police. Mr. Obiora said that yes, that he is always cooperative and that time he did not know that a shooting incident happened outside. Individuals in support: Homer Blow - 2803 W Capitol Dr - said that he supports the application because Mr. Obiora is never hesitant about cooperating with the police and always working with the community and that the incident is a very unfortunate one that took place outside but that the applicant has taken safety measures as well and always diligent and that if we are about to take a license away, we must have take the licenses from the entire city away. Angelique L Sharpe - 6161 N 60th St - Villard Ave Business Improvement - said that she is here to share her experiences from the past three years and that on 2022, Oasis was selected to help to bring the community back (sort of a drive) and that they were not only a financial contributor but a community partner allowing them to hold the concerts indoors because of the rain and by participating with a cultural mural, activities and community meetings. Added that Mr. Obiora is working with the police to make a safer community and to revive the neighborhood and that has up scaled the security team. Ald. Perez asked Ms. Sharpe if all the business are open as late as Oasis and if the other business are open during the day and if they have the same plan of operations because it would be a different world of perspective he said. Ms. Sharpe said that Oasis is not the only business that opens at night and pointed out the investment that they are making in their own business and the community. Ald. Perez said that he got a better feel of the environment rather than the business operations. Added that he visits the area frequently. Ald. Hamilton asked if anyone from the police department was present. He said that everything that Angelique and Homer Blow said about Oasis is true and gotten better with the years and have become an anchor or staple for the Villard Ave. but that he also wanted to be honest and said that they cannot scare away long time patrons with that kind of items on the police report. Also said that one of the things that he wants to see moving faster is that the applicant has total control of who promotes his business and there it be a commitment to his long time patrons to avoid situations that carries issues that lasts. Also asked the applicant to take care of those situations before he is brought back to committee again and to be committed to find a business model that does not bring him back here. Added that he wants to see this business succeed and be a model for this type of business and to raise the level of expectation and to continue the legacy of this business. Also said that he wanted to acknowledge what this business do for the business district and recommended renewal with a warning letter and to commit to find the business model that is needed to succeed. Ald. Kovac said that he wanted to circle back on the shooting item because the police report is very clear about the casings and floor on the floor and that the security guard missed all that. Mr. Obiora said that he was at the office at the moment and the security guard was checking customers so the guard was not able to see what happened because it happened so fast and from a moving vehicle and that the victims left right away. Added that last year he had a renewal with no issues and that now he has more security outside. Ald. Kovac said that the applicant is cooperative and with having the support of the alderperson and the community moved renewal with a warning letter based on the police report. (Prevailed 4-1)
