Title
Substitute Resolution authorizing an Amendment of Riverwalk Easement and Project Agreement for a Riverwalk segment adjoining the property at 333 North Water Street, in the 4th Aldermanic District.
Analysis
This substitute resolution directs the City of Milwaukee to enter into an Amendment of Riverwalk Easement and Project Agreement with the Board of Business Improvement District No. 2, Dehl Properties, LLC, Hines Acquisitions LLC and the City Milwaukee to provide public access to the riverwalk adjacent to 333 N Water Street.
Body
Whereas, Dehl Properties, LLC., is the owner (“Owner”) of the property located at 333 North Water Street (“Property”) and is conveying the Property to Hines Acquisitions LLC who will develop the Property ( “Developer”); and

Whereas, The Property is subject to a Riverwalk Easement and Project Agreement between the Board of Business Improvement District Number 2 (“BID 2”) and the prior owner of the Property {“Agreement”); and

Whereas, Owner took title to the Property subject to the Agreement; and

Whereas, Owner, Developer, and BID 2 wish to amend the Agreement to reflect the various rights and responsibilities regarding the existing Riverwalk adjacent to the Property; and

Whereas, Owner, Developer, and BID 2 wish to amend the Agreement to reflect the various rights and responsibilities regarding the alterations and additions to the Riverwalk that will be made as part of Developer’s development of the Property; and

Whereas, One of the alterations related to the Riverwalk requires the City of Milwaukee (“City”) to grant and easement for the placement of a retaining wall; and

Whereas, Upon taking ownership and completing its development, Developer is willing to maintain and operate the Riverwalk while granting access to and a right to use the Riverwalk to the general public in the form of a permanent public access easement; and
