This resolution authorizes the Office of the Common Council - City Clerk to retain outside counsel to assist the Common Council in preparing its response to the special counsel reviewing the adoption of Common Council File Number 201573, and appropriating funds for this purpose.

Body

Whereas, On March 2, 2021, the Common Council adopted Resolution File Number 201365, approving an amended and restated cooperation, contribution, and redevelopment agreement as well as personal guaranties, for the redevelopment of the property at 909 East Michigan Street for the Couture Project; and

 

Whereas, On March 19, 2021, the Common Council adopted Resolution File Number 201573, relating to the Amended and Restated Cooperation, Contribution, and Redevelopment Agreement as well as personal guaranties for the redevelopment of the property at 909 East Michigan Street for the Couture Project; and

 

Whereas, File Number 201573 rescinded File Number 201365 and directed the hiring of special counsel to review whether the Common Council’s actions adopting an amendment providing for a developer contribution to the Anti-Displacement Fund as part of the approval of the Amended Agreement were done in a manner consistent with law; and

 

Whereas, On May 25, 2021, the Common Council adopted Resolution File Number 210209, amending Common Council Resolution File Number 201573, to require the special counsel to submit his or her findings to the Common Council, Mayor, and the City Attorney no later than 90 days after the scope of work for the special counsel is agreed upon; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that the Office of the Common Council - City Clerk is authorized to retain outside counsel to assist the Common Council in preparing its response to the special counsel reviewing the adoption of Common Council File Number 201573; and, be it

 

Further Resolved, That an amount not to exceed $45,000 is appropriated from the City Attorney’s Outside Counsel Expert Witness Special Purpose Account Number 0001-1490-S157-006300 for the purpose of retaining outside counsel; and, be it

 

Further Resolved, That the City Attorney is directed to expend up to $45,000 from this account for this purpose upon identification of outside counsel.
