Analysis

This resolution authorizes the Commissioner of Public Works to execute an amendment to a Milwaukee Metropolitan Sewerage Green Infrastructure grant for the installation of bioswales within the medians of South 76th Street between West Waterford Avenue and West Honey Creek Drive in the 11h Aldermanic District. The amendment allows additional reimbursement to the City of Milwaukee in the amount $133,465. 

 

Body

Whereas, Common Council File No 180433 authorized the City to enter into an agreement (Green Infrastructure Funding Agreement W96001P38) with the Milwaukee Metropolitan Sewerage District (MMSD) to accept and fund a Green Infrastructure grant for the installation of bioswales on South 76th Street between West Waterford Avenue and West Honey Creek Drive; and

 

Whereas, Said File also authorized expenditures of $145,000 in grantor share and $80,000 in City share with a total project construction cost of $225,000; and

 

Whereas, MMSD has prepared Change Order One amending Section 4 of said agreement prepared Change Order One and is now is willing to reimburse the City of Milwaukee an additional $133,465 for a total of $278,465; and

 

Whereas, Said change order will provide additional $133,465 in grantor funds; and

 

Whereas, Common Council File Number 171710 authorized the expenditure of $140,000 in construction costs for the bioswales in South 76th Street (SM499160120)); and

 

Whereas, The unused portion of said capital funds shall be returned to the parent account; now, therefore, be it

 

Resolved, That the Commissioner of Public Works is authorized to accept MMSD Green Infrastructure Funding in accordance with Code Milwaukee 304-81, and to enter into the Change Order One document in the form submitted to this file, or in material conformance therewith; and, be it

 

Further Resolved, That upon the full execution of the Change Order document, the City Comptroller is authorized to create within the Capital Grant and Aid Projects Fund the appropriate Project/Grant Chartfield Value for this project, and transfer to these accounts the amount required under the agreement and City accounting policy, but not to exceed a ten percent increase of the total amounts reserved for the grantor’s share and local share or $5,000, whichever is greater, as follows:

; and, be it

 

Further Resolved, That these funds are appropriated to the Department of Public Works, which is authorized to expend from the amount budgeted for specific purposes as indicated in the grant budgets and incur costs consistent with the award date; and, be it

 

Further Resolved, That the Commissioner of Public Works shall have the authority to authorize transfers within the project budget so long as the amount expended for any purpose shall not exceed the amount authorized by the budget by 10% and such transfers are in accordance with grantor regulations; and, be it

 

Further Resolved, That the Commissioner of Public Works, on behalf of the City of Milwaukee, is authorized to enter into subcontracts (and leases) as detailed in the project budget and in accordance with City purchasing procedures and grant and aid guidelines for awarding such contracts.
