Analysis

This resolution amends a lease agreement with United States Cellular Operating Company, Inc. (U.S. Cellular) for the placement of personal communications services antennas at Hawley Road Water Tower at 5701 W. McKinley Ave., which was authorized by Common Council Resolution File Number 050361 adopted on July 26, 2005 and amended by Common Council Resolution File Number 121464.

 

Body

Whereas, The Common Council adopted Resolution File Number 050361 on July 26, 2005, approving a 5-year lease agreement with U.S. Cellular for the placement of personal communications services antennas at the Hawley Road Water Tower at 5701 W. McKinley Ave.; and

 

Whereas, The Common Council adopted Resolution File Number 131464 on March 4, 2014, approving a first amendment to lease agreement that allowed U.S. Cellular to upgrade its equipment; and

 

Whereas, This second amendment of the lease agreement between the City and U.S. Cellular for the placement of personal communications services antennas at the Hawley Road Water Tower at 5701 W. McKinley Ave., allows U.S. Cellular to upgrade its facilities; and

 

Whereas, The lease amendment offers a fair market value to the City, protects other City interests, and is acceptable to all City participants; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that the Common Council approves and amends the lease agreement, identified as the "Second Amendment to Lease Agreement," between the City of Milwaukee and U.S. Cellular for the placement of personal communications services antennas at the Hawley Road Water Tower at 5701 W. McKinley Ave., a copy of which is attached to this file, and authorizes the proper City officials to enter into this lease agreement on behalf of the City of Milwaukee.
