Title

Substitute resolution cancelling real estate taxes levied against a certain parcel bearing a tax key number on the 2019 tax roll, plus interest and special charges applicable, if appropriate.

Analysis

This resolution cancels 2019 property taxes of $4,629.42, including interest charges, for the property at 2427 W. National Avenue owned by Iglesia Apostolica Nueva Vida, Inc., aka New Life Apostolic Church.

 

Body

Whereas, Iglesia Apostolica Nueva Vida, Inc., purchased the property at 2427 W. National Avenue (tax key no. 4340604000) on April 30, 2018, to operate the New Life Apostolic Church; and

 

Whereas, The City Assessor classified the 2427 W. National Avenue parcel as local commercial based on the owner’s failure to provide the documents necessary to be granted an exemption from City property taxes as a non-profit entity, making it a taxable property; and

 

Whereas, Iglesia Apostolica Nueva Vida, Inc., maintains an error in completing its Wisconsin corporate registration which resulted in registration as a for-profit corporation rather than a not-for-profit has prevented it from gaining an exemption from City property taxes in 2018 and 2019; and

 

Whereas, Iglesia Apostolica Nueva Vida, Inc., paid its 2018 property tax bill of $5,433.69 while seeking property tax exemption from the City as a not-for-profit corporation; and

 

Whereas, While Iglesia Apostolica Nueva Vida, Inc., maintains it registered as a not-for-profit corporation in November, 2019, and believed it qualified for an exemption from City property taxes for 2019, a 2019 property tax bill of $4,494.57 was issued; and

 

Whereas, Iglesia Apostolica Nueva Vida, Inc., has not paid the 2019 property tax bill, and interest of $134.85 has been charged, making the total balance owed $4,629.42; and

 

Whereas, Iglesia Apostolica Nueva Vida, Inc., expects to provide all documents necessary to be granted an exemption from City property taxes as a non-profit entity in the near future; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that the proper City officials are directed to cancel the 2019 property taxes, plus any interest and special assessment charges, for tax key no. 4340604000 (2427 W. National Avenue); and, be it

 

Further Resolved, That the proper City officers are authorized and directed to reflect the reduction in State Tax Credits resulting in this property tax cancelation through journal entries, charging the 2020 Remission of Taxes Fund, 0001 Org 9990 Program 0001 Subclass S163 Account 006300, and crediting the State Tax Credit Fund.
