This resolution authorizes the Commissioner of Public Works to execute a Maintenance Covenant document titled Green Infrastructure Ten-Year Maintenance Covenant for green infrastructure located in the medians of North 107th Street between West Good Hope Road and West Brown Deer Road, in the 9th Aldermanic District.

Body
Whereas, Stormwater pollution control is an important component of the City of Milwaukee’s (City) storm water management regulations and the City’s stormwater permit with the Wisconsin Department of Natural Resources (DNR); and

Whereas, Nonpoint sources such as roadways have been recognized as the primary source of environmental pollution by discharging polluted runoff directly into the local streams and water bodies, threatening natural habitat and species; and

Whereas, In 2016, the City was awarded Green Solutions Funding from Milwaukee Metropolitan Sewerage District (MMSD); and

Whereas, The funds allowed the construction of bioswales in the medians of North 107th Street between West Good Hope Road and West Brown Deer Road; and

Whereas, The agreement for said funding stipulated that, in order for the MMSD to reimburse the City of the cost of the project, the City shall execute a maintenance covenant in favor of MMSD; and

Whereas, MMSD has drafted said covenant which shall be in effect for a period of ten years; now therefore, be it;
