Attorney Gartner stated as part of the grant, HACM is required to record this Easement, which is the last step to securing the release of the $100,000.00 grant that will fund a portion of those costs. WHEREAS, Westlawn Gardens is generally situated to the south of West Silver Spring Drive between North 60^th Street and North 68^th Street and the Housing Authority of the City of Milwaukee (HACM) is currently proceeding with redevelopment of Westlawn Gardens; and

WHEREAS, the Milwaukee Metropolitan Sewerage District (“MMSD”) awarded a grant to HACM to fund a portion of the cost of constructing an underground detention basin to serve Westlawn Gardens beneath the Browning School Playground and requires a Limited Term Conservation Easement (“Conservation Easement”) providing for long term maintenance of the underground detention basin as a condition of funding the grant; and

WHEREAS, a Conservation Easement  by and between HACM and MMSD providing for long term maintenance of the underground detention basin beneath the Browning School playground is on file with HACM; and

WHEREAS, pursuant to this Resolution the Commissioners of HACM desire to approve and authorize execution of the Limited Term Conservation Easement by the Secretary - Executive Director on behalf of HACM.

NOW, THEREFORE, BE IT RESOLVED, by the Housing Authority of the City of Milwaukee that the Limited Term Conservation Easement is hereby approved and the proper officers are hereby authorized and directed to execute and deliver the Limited Term Conservation Easement in substantially the form on file with HACM or in such form and substance as may be approved by the Secretary-Executive Director.
