Analysis

This substitute resolution authorizes payment of the settlement of Deron Love v. Rodolfo Gomez, Jr.,, Milwaukee County Circuit Court Case Number 14-CV-8608 in the amount of $100,000.

Body

Whereas, Plaintiff Deron Love filed a civil rights lawsuit against Rodolfo Gomez, Jr., in his capacity as an employee of the City of Milwaukee Police Department alleging the use of excessive force, and

Whereas, the City participated in mediation, which resulted in proposed resolution of the lawsuit with the amount of $100,000, with certain terms and conditions; and

Whereas plaintiff has accepted the terms and conditions of the proposed resolution, and

Whereas, the City Attorney recommends and the Common Council of the City of Milwaukee deems it expeditious and just to pay the offered amount; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that proper City officers be and hereby are authorized and directed to issue a check for $100,000., payable to Walter W. Stern Trust Account, 920 85^th Street #123, Kenosha, WI 53143,  in full and final payment of any claims raised in the subject lawsuit, upon receipt of a Release of Claims, approved as to form and execution by the City Attorney; said amount to be charged to Damages and Claims Account-636505 - Fund No. 0001 - Organization 1490 - Program 2632 - Sub Class S118.
