Resolution authorizing payment in the settlement of Wisconsin Fair Employment Act (“WFEA”) claims made by Royce R. Nash II.

 

Analysis

This resolution authorizes settlement of WFEA claims in the total amount of $145,000, which represents full compensation for damages for any liability, as well as any potential attorney’s fees and costs related to the litigation.

 

Body

Whereas, Royce R. Nash II filed a claim in the Equal Rights Division of the State of Wisconsin seeking damages for alleged instances of discrimination and retaliation under the WFEA as a former employee of the City of Milwaukee; and

 

Whereas, The title of that case is Royce R. Nash II v. City of Milwaukee, ERD Case No. CR201800706, cross-filed with the United States Equal Employment Opportunity Commission, Case No. 26G201800605C; and

 

Whereas, The claimant has agreed to settle his claims in the amount of $145,000; and

 

Whereas, The City Attorney recommends and the Common Council of the City of Milwaukee deems it is expeditious and just to settle this claim, and now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee that the proper City officers are directed to issue a check in the amount of $50,000, payable to Royce Nash and reported on a W-2, upon receipt of a release of claims, approved as to form and execution by the City Attorney, said check to be delivered to the City Attorney upon his request, said amount to be charged to the following account of the Department of Employee Relations: Account No. 00600, Fund No. 001, Department No. 1650, Class No. R999; and be it

 

Further Resolved, By the Common Council of the City of Milwaukee that the proper City officers are directed to issue a check in the amount of $50,000, payable to Royce Nash and reported on a 1099, upon receipt of a release of claims, approved as to form and execution by the City Attorney, said check to be delivered to the City Attorney upon his request, said amount to be charged to the Damages and Claims Fund, Account No. 0001-1490-S118-006300; and be it

 

Further Resolved, By the Common Council of the City of Milwaukee that the proper City officers are directed to issue a check in the amount of $45,000, payable to Fox & Fox, S.C., upon receipt of a release of claims, approved as to form and execution by the City Attorney, said check to be delivered to the City Attorney upon his request, said amount to be charged to the Damages and Claims Fund, Account No. 0001-1490-S118-006300; and be it

 

Further Resolved, That the law firm of Fox & Fox, S.C., shall upon receipt of the executed settlement agreement file a release of claim with the State of Wisconsin Equal Rights Division and the local office of the Equal Employment Opportunity Commission.
