Title

Resolution authorizing City execution of an Agreement between the City of Milwaukee and the Milwaukee Metropolitan Sewerage District regarding the Kinnickinnic River Flood Management Project for an area abutting the Kinnickinnic River between South 6^th and South 16^th Streets, in the 12^th and 14^th Aldermanic Districts.

Analysis

This resolution authorizes City execution of an Agreement between the City of Milwaukee and the Milwaukee Metropolitan Sewerage District regarding the Kinnickinnic River Flood Management, in the 12^th and 14^th Aldermanic Districts, which Agreement includes, among other things, reconstruction of City-owned bridges, modifications to City-owned sewers, and modification to City-owned water mains.

Body

Whereas, The Kinnickinnic River flows through the City of Milwaukee, and currently has over 300 residential structures within the one percent annual probability floodplain; and

Whereas, The Milwaukee Metropolitan Sewerage District (MMSD) is undertaking the Kinnickinnic River Flood Management Project (Project) to expand the River Channel and replace the existing concrete-lined channel to a more naturalized stream design; and

Whereas, MMSD has acquired numerous residential structures between South 6^th and South 16^th Streets and has removed the structures and has performed certain improvements related to street and alley vacations; and

Whereas, MMSD’s work for this Project will involve removal and replacement of City-owned vehicle and pedestrian bridges to accommodate the expanded River Channel; and

Whereas, MMSD’s work for this Project will also require relocation of various City-owned sewer, lighting and other utility facilities; and

Whereas, The City desires to cooperate with MMSD to facilitate implementation of the Project; and

Whereas, MMSD the Agreement that has been submitted to this file establishing the respective duties and responsibilities of the City and of MMSD necessary for the implementation of the Project; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee that the proposed Agreement that is part of this file is hereby approved, and the appropriate City officers and employees, including the Commissioner of Public Works, are hereby authorized to sign the Agreement, or one in substantially the same form and substance as submitted, and to undertake such acts as are required of the City thereunder or in furtherance thereof, to effectuate the Agreement and this resolution, including signing of deeds and easements contemplated and required by the Agreement; and, be it

Further Resolved, That any expenditure of City funds that may be necessary as a result of the City signing the Agreement will be brought forth for Common Council consideration and approval.
